lease question

lease question

so my landlord hasn't sent me a new lease yet, but I have him in email saying it was fine to live at my current apartment another year. So would that hold up in court for some reason? My thinking, he can't kick me out because I have it in writing that he gave us permission to live there another 12 months, but if for some reason I want to leave early and buy a place, I don't have a lease binding me. I don't know if this is the case, but let any input would be appreciated.

You can't have it both ways, if he is bound by the lease so are you.

If he accepts your rent check on the month concluding the 1 year lease...the lease is now month to month. Im pretty sure he's not trying to screw you over, but he can kick you out at anytime....so if you want to leave, you just have to let him know. Basically, you guys have a verbal agreement for a year, but nothing is binding.

He can't kick you out until the end of the month. So as long as he keeps cashing your checks he can't/won't kick you out. Remember, you pre-pay for rent.

BTW, I'm in the exact same position.

Well, obviously, he accepted your check, but the next month, he could decide he doesnt want you as a tenant anymore.

Best to get a new lease signed.
