Okay so I'm sitting at my desk today next to Cathi. He comes over to Cathi's desk and asks her a question. Then he says "Beth I have to ask you a question.." I turn around to see what he's talking about and he leans forward and LICKS MY FUCKING EARLOBE!! WTF!! So I just swing a right hook right into his damn arm. I was so shocked. He just walked away and didn't say anything. My manager was in a two-hour meeting (of course), so as soon as he came out we went in the conference room and I showed him the emails.
He immediately called my HR rep. I went and talked to her and she took my version of the story. She says that since he physically touched me it can get really serious. She's going to talk to him tomorrow while I'm not there. I won't see him again until Monday.
The only thing I'm scared about is his reaction. He has no clue I went to HR today. I don't want him to freak out or something and follow me home from work. Today at my desk I literally tensed up every time he walked by. I hate this.......what if he goes psycho?

Other then that, the emails alone should be enough for any action to be looked into, its bullshit if they said its wasnt untill he physically touched you.
You just have to wait and see. If your company decides to not do antyhing about it, then you need to look them in the eye and say fine, then maybe a personal lawyer will and walk away. They come after and then you are in control from there.

id be pissed off that the company cant do anything about the email just because it happened off work hours, i mean, arent they arriving your company email account? its still sexual harassment no matter what they say. this creepy guy needs to be taken out of the workplace before he scares some poor girl into sleeping with him

And this guy is married? You sure? See what happens with your work. They are legally responsable here to provide you with a safe workplace. If the guy goes nuts call the cops. Most states require a police report(or several) before they will give a restraining order out. Most don't do anything anyway. If he becomes unstable after this best thing to do is ask a male friend who he never saw to pay him a visit one dark night, or early morning. If all else fails, I'd go right over to his wife & talk to her. Afterall you didn't do anything so she shouldn't be mad at you.

i find it hard to believe the company can't do anything simply b/c it was after hours...with my company, we can't surf Ebay or Hotmail at ANY time, day or night, b/c we're using the company's servers, hence the company is responsible
with that company's rationale, any employee can theoretically send death threats to a million people in the middle of the night, and the company doesn't have to do anything about it b/c it was after hours

The ear licking thing was the last straw. It's now "battery".. and depending how strongly you feel about it, I'd consider filling out a police report. It's pretty obvious work isn't going to help you with this.
Unfortunately, this is what I was talking about before with trying to handle things "normally" at first. Cuz most of the time it hurts the accuser as much as the one making advances. Obviously it depends on the co, but it seems like they're trying to steer clear of it.
Anyhow, if he does it again, def. call the cops. It's that simple. If you've tried to tell him nicely, then not so nicely, then he licks you (bodily fluids?!?! wtf), I wouldn't hesitate to call the cops. You really don't know what he'll do next.
And if this escalates you will probably have to find new employment--if for no other reason this guy won't be able to find & harass you.

Your company is responsible no matter what time those e-mails were sent - Hopefully you get a call from HR saying they let him go - After that, go to the Police Station and get a restraining order....It sounds wierd, but you don't want to be the subject of a story on Americas Most Wanted or Cops or some shit

yeah me and my dad split at the same time.
their marraige was dead a couple years after i was born.
I cant live in the same house with my mom, and i only visit her oh so often. we fight like nothing else.

he's 100% right. Your Hr person is incorrect. If an employee of theirs is making you feel uncomfortable in the workplace to the extent where you can't do your job, they are required to do something or you have a host of legal options you can take, the first of which would be sueing the hell out of them. I'm not big on our society's huge "sue everyone" mentality, but you def have options...

I do need to clarify though....he didn't email me on our WORK email. We have a personal email list at work that some people share funny jokes/pics etc on. He got my personal email off of that list. Since it wasn't "work" related they can't touch that.
The ear-licking thing is very serious though. He's getting talked to today about it. I really am nervous about the outcome though....
And I think that a group of CL getaway cars would be the coolest thing ever! Road trip hell yeah! Bring y0 sleeping bags and we'll order pizza the night before! I'll make chocolate chip cookies!
