Angry Trans shop trying to screw me!

I had my trans "rebuilt" 6k miles ago.

Last time I checked, a shop is supposed to inspect everything first to see what is in fact broken & in need of replacement.

Well they apparently did not do that b/c pretty much from day 1 that I got the car back it was doing almost the same crap as before I brought it in!!

The trans died again earlier this week. So the car was towed to them & they tell me today the planetary gears are toast & that is not something that is replaced on a standard rebuild. Right, I know that's not a standard item to be replaced.

But if you toolbags actually inspected my tranny before you just tossed parts at it to get my $ you would have replaced the CORRECT parts the first time!!

Now I'm pretty pissed right now & don't think I should pay a dime. I most certainly will NOT pay for labor though. Not only that, but the trans is still under this shop's warranty period of 1 year/12k miles. Only 6k miles have passed.

Here is what the paperwork says about the differential:

"THE DIFFERENTIAL ASSEMBLY HAS BEEN VISUALLY EXAMINED AND FOUND TO BE IN ACCEPTABLE OPERATING CONDITION. EXCEPT AS MAY BE OTHERWISE PROVIDED BY STATE OR FEDERAL LAW. WARRANTOR ASSUMES NO RESPONSIBILITY FOR ANY SUBSEQUENT FAILURE OF THIS COMPONENT."

There are no planetary gears in a differential - regardless of manufacturer.

If they told you the reason for failure (this time) is planetary gears - and they refer you to a section in their paperwork referring to differentials - raise the BS flag.

Differentials in a FWD unit look very much like a RWD unit... Ring, pinion, spider gears, bearings, etc...

Is it the tranny or diff that failed? If it's the tranny, what does the diff warranty have to do with it?

He said the planetary gears in the trans are toast & then he said something about the differential too. So I'm sure he's gonna say that went byebye as well

Did you take it back when you first starting having trouble or did you wait until it died?

There was a day where I took it in & told them it's still acting up. They drove it & found nothing wrong.

I believe the issue here is the fact that they did "work" on my car, but never actually fixed the original problem due to their sheer neglect & apparent lack of actually inspecting a damn thing.

I would take them to court and try to scare them into settling outside court. The perfect arguement you can raise is that you told them the problem first, they inspected it and rebuilt it then gave it back to me with the same problems. The transmission has a 1 year/12k warrenty on it and this should be covered. I say this because the matifuction of these parts in question were not checked even thought they should have been. Also getting a letter from a other transmission shop on their work would be a good idea to help back you up in court if you do decide to go.

That you only took it back one time and were able to drive it another 6k hurts your arguement that they never fixed the problem.

They can say the planetary gears were ok when they did the tranny, and as it did go another 6k miles it's going to be hard to prove they didn't. Unless you can show that the repair they did failed and that caused the planetary gears to go I think the best you can hope for is a price break on the next repair as "goodwill".

I hate to say it but I think you are sol.

Their paperwork doesn't exclude the gears. They gave me the car back w/a clean bill of health & stuck their warranty on it. It's on them. They fucked up.

How does the warranty read?

If their warranty covers all the tranny you should be able to collect on the tranny (the diff is still on you). If the warranty is just on what they replaced then you may be out of luck.

paperwork says nothing about anything in the trans being excluded.

I just got off the phone w/the guy & he started to accuse me beating the shitter b/c the pump was bad & that doesn't just go bad. No shit, but don't you dare try to shift the blame on me for your neglect. I then said I assume this is all covered under warranty & he pretty much agreed then he said he's waiting to see what "they" do on the planetary gears. I held off on flipping out on him for now. If he tries to charge me for them then it's time to play hardball.

If all goes well I should have my car back some time this week. It better be runnign right this time.

2 weeks later & I still do not have my car back. $100 says they laugh at me when I go in there to pick it up (hopefully sometime this year) and tell them they should pay for my rental. :angryfire :angryfire :angryfire :angryfire

I got the same bs runaround again today. Oh yea, I'll have my guy stay late today to finish it. Bullcrap, my car sits outside in the same spot. I am calling tomorrow and telling him that the car must be completed today. I won't mention court or anything, but if it's not done I'm going to find out what I need to do to file in small claims.

Man, that sucks. If I were you I'd hire a tow truck and get my car out of there. Even if they do get around to fixing it, I wouldn't trust their work after everything that has happened.
