New York Driver Responsibility Assessment, Need Help
Hey everyone, I recently was driving into NY and got a speeding ticket on the Hutchinson pkwy out of all places. Regardless, it was a 77 in a 55 and I pled guilty at which point they just sent me my $270 fine earlier this week (which i have yet to send in..due the 17th). I thought it was water under the bridge until today when I received a letter from the "New York Driver Responsibility Assessment" stating:
"...motorists who accumulate 6 or more points on their driving record in an 18 month period, or who are convicted of a drug/alcohol violation or who refuse a chemical test, must pay a Driver Responsibility Assessment in addition to any fines, penalties and surcharges that are assessed by the courts. This applies to all drivers regardless of where they are licensed. Assesments which are billed every year for 3 years, are $100 per year for the first 6 points.." (aka $300, or $100 every year)
My speeding violation was conveniently assessed as 6 points. It also states that I can't take defensive driving courses to reduce the assessment. It's ridiculous because had I known, I would have pled NOT guilty and got atleast one point reduced. I also haven't had a violation or anything of the sort in the past 18 months so having them give me exactly 6 points is just ridiculous, it's like a loophole to get $300 more dollars on top of a $300 ticket. What else gets me is that it applies to all drivers even out of state (i'm from CT). Anyways, any advice or legal advice you guys can offer would be greatly appreciated.
