Need Advice, NY Traffic Court F&$king Me Over

I recently accepted a new job offer, and in the process they ran a background check. It came back with two unresolved issues from NY in April of 2008. One is a minor speeding violation, the other is considered a Class 3 Misdemeanor (driving with a suspended license). The new company doesnt care about the speeding ticket, but they are concerned about the misdemeanor - as am I.

The thing is, I took care of these offenses in July of 2008. My license was reinstated, and everything has been clean since then. No other background checks came up with this information. I even had one of my friends, a PO in NY, run my info and it there were no outstanding warrants or anything to show that this was not taken care of.

I filed a dispute with the company (ADP) that handles the background checks. I also called the court in NY, got the run around, and finally got the number to a department head - which I left a message for.

My start date with the new company is Feb 6th. The company said once they receive confirmation that I submitted the dispute, they have no problem bringing me on as a contingency employee. Once this issue is taken care of, they will change my status.

Does anyone have any experience with this bullshit or know of a way to get it taken care of ASAP? Ive been pulling out what little hair I have left since they called me about this.

BTW - Not sure if this belongs in Car Talk, but it does involve a traffic infraction.

Did you hire a lawyer to take care the issue? If yes, then I'd get in touch with him and ask what's going on

Im in IT. They like to change my title every now and then. Most recently it was System Administrator, even though it technically wasnt Ive been working on the same contracts for the past 5 years or so, just with different companies.

If you have any of the paperwork from the case or whatever fines/action you had to take it would help. If not, you can try to run a driver abstract against your NY license and it would show what infractions you recd and when they cleared, its essentially a complete breakdown of everything ever tied to your license. You can do it online and they also mail it to you and I think it cos $20.00

Otherwise, if time is not on your hand I would get a traffic lawyer in whatever area you recd the tickets from and have them clear it in the courts.

The only thing I have (somewhere) is a receipt. They didnt give me any other paperwork. I really hope I dont need to get a lawyer but I will in the worst case scenario.

If it didn't show up when your friend the cop ran your name, then I'm, thinking ADP is holding on to old info or inaccurate info.

It sounds to me like it's going to be easier to get records from the court to prove that the issue is resolved than it would be to get ADP to admit that they made a mistake. With that said, I'd still contact your most local ADP branch and establish communications with them, too.

How was the misdemeanor handled? Did you have to tossed or were you found guilty?

My mom had this problem with adp & NYC. She was working for a credit card company in FL. They did BG checks & she was hired. Well a week later she was pulled into hr. The check from adp came back with a credit card theft arrest from 1974! her dumb ass found a CC & tried to use it. She was arrested, & booked, but it was dismissed. She was fired right there for obvious reasons. Many calls to adp & me trying to get the NYC court records from 30 years ago was fun. My mom decided to just let it go cause it was a PITA to get the records.
There was a FBI check & nothing came back on the that.

Dropped to a moving violation, which I paid the fine for. The suspended license was due to a separate occasion, which was taken care of beforehand.

Whats odd is Ive had a few background checks since 2008 and this hasn't shown up. At least one of the checks was ran through ADP too. This completely blind sided me and ruined my day.

Quite frankly, I don't see what the problem is...misdemeanor or not, it's a traffic violation; it's not like you beat the shit out of somebody or mugged an old lady.

First off, congrats on the new position! Glad to hear that the company's still willing to take you on and is patient enough to allow you to take care of this BS. I don't know what the job market is like for IT professionals, but I don't think most employers would give a second thought to hiring another candidate just as quickly.

Have you checked online to see if others have had similar problems with ADP? It might help your situation if you have a few other stories on hand, either for your employer or anyone else.

Any idea when you'll hear back from them?

I left another voicemail for the department head in NY. I havent heard anything else other then a confirmation that ADP received my dispute.

Pull the abstract and use that as your receipt, can possibly show to your potential employer that you did clear it and tied up all the loose ends.

What state would I pull that from though? Im licensed in VA and have been since late 2008.

I would assume NY or both if you really need it, just enough to prove it to your new employer and work out ADP issues later?

Can't you just go to the DMV or records office, pay $10 and get a copy of your driving record? Wouldn't that show that you're "all clear"?

Which you know as true and is true. The abstract will pretty much say when the infraction was opened and when it was closed thus proof that it was closed, your receipt

Morgan, i would go to your local court and police station to see if anything pulls up....

then tell the background check company what pulls up....

my girl recently was a victim of something similar....she got pulled over and the cop said she has a warrant on her name....she had a ticket back in 2007 and paid $38 and for $0.40 cents and hence it came as unpaid....

see with your local authorities to see if something like that comes up....

Update - Yes, Im still pulling my hair out over this.

After over two weeks of leaving voice mails for the department head at the traffic court, she finally calls me back. She says the violations on my record are closed in her computers. I explain the situation, she tells me to hold while she checks the DMV computers. She comes back and tells me those tickets were transferred to District Court. Fuck.

I spoke to my friend, the cop, and he says its possible they werent filed right away and since I no longer had a NY license I didnt receive any notification. He said just go to court, pay the fine, and be done with it.

Just to make sure Im going there armed appropriately, I called my sisters friend, an ADA in the next county over. I explain everything, he says get the drivers abstract, tell him whats on it, and he'll tell me what I need to do from there.

I go to the NYS DMV website, follow the links, and see that I can get an abstract right now for $7. Cool, I just need to sign up on the DMV website to get the ball rolling. Except that I need a NYS issued ID in order to register. I dont have one. I dug through all my files to see if the ID and document number were listed anywhere. I managed to locate my learners permit. I type in the ID numbers, fill in everything else, and it comes back invalid. I go through it 3 more times, making sure everything is filled out properly. No dice. I even tried my VA license number. Still invalid.

I have two options now. Order by mail and wait two weeks or go to an NY DMV in person. Unfortunately I can't have someone go for me since I need to show them my ID. Which, since it's a VA drivers license, something tells me they'll give me the run around because of it.

Im going to call the company that ran the background check Monday (hoping theyre not closed) and ask if they have my drivers abstract. If they do, I need a copy of it. I need to check up on the law, but I believe I am entitled to receive a copy of it. If not, Ill request an extension from the HR department so I can order the abstract by mail. Worst case - Ill be in NY sometime this week to take care of this shit once and for all.

In hindsight, I wish I listened to you guys two weeks ago and ordered the drivers abstract then.

That sucks to hear. Not sure if it applies to abstracts but their is typically a release form you can fill out and sign which will allow someone to act on your behalf. Not sure if you still have any friends/fam in NY that you feel comfortable with giving your personal info to but that may be a option.

Ive got it, started Feb 6th. My employment is still contingent upon the outcome of this mess though. Once ADP finishes their investigation, they will contact me and my employer to let them know their findings. I wasn't going to wait to come back though, thats why I did my own digging. The investigations usually take about 30 days to complete, which leaves me with about 2 weeks left. Im going to call them tomorrow (if theyre closed, Tuesday) and ask about the abstract. I do, but unfortunately they all work 9-5s and dont have time to sit at the DMV for hours.
