because of the complications it's really not worth it to go after this car dealer.
yes this will happen again to others and they will still be powerless because of the laws across states to enforce breach of contract. I will spend thousands on a lawyer to actually go to Nevada and sue them and in the end I'll probably lose due to the fact that the court cannot force them to sell me the car or rather will not. Nobody cares and I suppose I've done all the research I need to realize that.
This is the last time I purchase a large item from ebay again.

Anyone notice the new screen that pops up when you place a bid? Saying it's a law abiding contract and both seller and buyer must complete transaction. You are getting a deal here, i'd take it to the courts.
did you call the GM?

They sure as hell do as per ebay rules
here is the confirmation when you bid
"You are agreeing to a contract -- You will enter into a legally binding contract to purchase the item from the seller if you're the winning bidder. You are responsible for reading the full item listing, including the seller's instructions and accepted payment methods. Seller assumes all responsibility for listing this item.

Yes, I've spoken to the VP of the company even. She says she won't sell it to me.

I'll continue trying through ebay and square trade as well as the Better Business Bureau. In court I have not taken any damages so I cannot yet sue. We'll see about that after Ebay and Squaretrade are done.

They Fux0r3d up, why does that mean you the one in the right has to suffer the consequences ?~!?!?
This blows![Rant](https://acurazine.com/forums/images/smilies/rant.gif)

Civic, you should put up an auction for a G35 just like theirs. Start it really low to attract as much attention as possible. Then in the inside put your story about the dealership and fuck them.

Fuck the dealer. You're rigt about it not being worth it, now you should just do as much as possible to fuck their reputation. Call Nissan/Infinity of America and tell them. Notifying the BBB and Ebay right away was good. Now post this shit all over the net. G35 forums, everywhere. And list the VIN and tell people don't buy the car because they backed out of a LEGALY BINDING contract. LIke others have said, if you backed out if it went for 40k they sure as hell would be pissed. I also like KCPreki's idea about the ebay auction.

well looks like ebay has let them get away. I forwarded them the e-mail and headers from internetsales@towbininfiniti.com . however, the front company for towbin infiniti that was in the auction was ebizautos and so ebay has told me they will not pursue the non-selling seller report.
I suppose there really isn't anything left to do...

So your saying Ebay is doing NOTHING at all about this? Could you turn Ebay into the BBB for this as well now with them not wanting to help a customer complaint.

Maybe there is something we could all do? Does anyone have some sort of experience in media coverage? Maybe you can totally screw them over somehow with negative media coverage that they might be willing to take the loss. Of course, it would be nice if you lived in visiting distance of the dealership but oh well.

http://forums.nasioc.com/forums/show...9&page=1&pp=50some things have already begun on this forum.
they've complained to the dealer as well as infiniti and other media outlets.
I've let 3 TV stations in Vegas know about the matter as well as teh Las Vegas Review Journal and Las Vegas Sun.

I wish you luck in your revenge campaign, but I doubt you’ll get very far.
There is a disclaimer in their auction that they can end the sale if the car is previously sold.
If anyone at the dealership has half a brain they will quickly trade the car to another dealer and say it isn’t for sale anymore.![Dunno](https://acurazine.com/forums/images/smilies/dunno.gif)
That's cheaper for them then selling it for your winning bid or dealing with a lawsuit.

I think they have to close the auction if they sell it on the side.

At least reaching out to other members I can let them know of the shady dealings by this dealer.
I know you won't get anywhere with them really either, but the more you can fuck their reptuation, the better as your right, you probably won't get anywhere suing them.

Civic, don't you have any friends who work as attorneys?
There is so much pondering going on in this thread. This deals w/ thousands of dollars. Get a definitve answer from a couple of people/institutions so you know exactly if you could win or if it's a waste of time.

Here's what I wrote to them. Also saw this on NASIOC. Hopefully this will get out of control (in a good way) like it did with Mark Mitsubishi.
ATTN: General Manager
To Whom It May Concern:
I have recently come across the story of a fellow automotive enthusiast bidding on a 2003 Infiniti G35 coupe. He won the auction at the price of 23,600 dollars (reference, auction #2498214998, but I'm sure you already know what this is about by now).
As an avid eBay user, I have looked through the auction and everything looked legitimate... except for the shady business practices of Towbin Infiniti. Simply put, you just do not want to sell the car at this price because it would create a loss for you in the transaction. While that is unfortunate for you, let me tell you that eBay auctions are legal binding contracts.
You cannot just blame it on human error (yours words; what human error, anyway?) and refuse to sell the vehicle to the rightful winning bidder. If the situation had been reversed, you would track down the winning bidder and make him pay.
I am not going to make this any longer, because businesses such as yours disgust me. But I will end this E-mail on a couple of notes. First, do not underestimate the power of the Internet message boards and their automotive enthusiasts. Last time something like this happened, the dealership went through hell and eventually paid for their actions. Go ahead and look it up yourself -- their name was Mark Mitsubishi and it was the exact same situation as now. The dealership refused to sell the vehicle to the rightful winning bidder because the price was not what they wanted.
Second and last, it seems that you have already received bad reputation in the past, and been questioned for your shady business practices. Let me provide you with the links to these stories for your convenience.

I am pleased to say that even though it has only been a few days, many fellow message board members have contacted the appropriate government agencies and Infiniti headquarters to look into the matter. Also I am quite sure that Las Vegas Review Journal, along with many other channels of media, would love to hear of this story. It will be another story to reveal to the general public just how shady your business has been in the past, and still is now. Mark Mitsubishi legally and socially suffered for weeks and weeks for their bad actions. This case is no different from the above for us automotive enthusiasts. We are sick of dealerships like you pulling stunts, and we are going to do everything we can to fix the situation, just like we did with Mark Mitsubishi.
Have a nice day, and good luck with your shady business.

I wrote to BBB, Mitsubishi HQ, and the GM of the dealership when Mark Mitsubishi was questioned for their shady practices. I focking hate dealership bullshit like this. ![Mad](https://acurazine.com/forums/images/smilies/mad.gif)
I'm going to watch what happens on NASIOC for a day or two, and if necessary, I'll most likely write to Infiniti HQ, BBB, and the Attorney General.
