HELP Ebay Car Dealer BASTARD

I won this auction fair and square.
Now the guy Franklin at the dealership refuses to sell it to me for the price I won it for.

Anybody know what I can do about this?

Dont know the legals of Ebay, but i would start by calling the GM of the dealership.

The car is worth almost $33k so I can understand the dealership not wanting to sell it for $23,6. Read the ebay rules and see if the dealer is in the right. Sometimes you can back out of a sale. If they are wrong go to ebay and have them take action. You might be able to get the dealer blacklisted on ebay so they can't sell online anymore. good luck

Anyone remember that other guy who won the STI auction and the dealer renegged? There was this huge thread on another board and people jumped on board and started calling the dealer, stopping by, harassing them to sell the car at the price it was won. I think the kid ended up getting it too. And the internet sales manager lost his job.

Damb, that really sucks. Make sure you printout and save a copy of the auction for safekeeping.

I was under the impression a ebay auction was a legal binding contract to sell/purchase...

You're gonna have to drag this one out. Thats a good deal. It is a binding contract, and i'm sure he'd throw a fit if the car reached $43k and You refused to pay. I'm sure he'd throw out all this legal stuff at ya, Ebay rules, etc etc. So do it to him. Call the GM first, and see what happens there. If no luck, report him to Ebay, etc etc to whoever you can. Might want to try a lawyer, just to see what he says if the earlier attempts dont work.


BTW, if you list a car with no reserve, thats your choice, dont be a bitch and not sell when you didnt get what you wanted for it.

Yeah, if he didnt list it with a reserve price or put some clause in the item auction that he reserves the right to end the auction at any time, then he should have to sell the car at that price. (But he didnt end it he let it end with someone winning it)

I would stick with it and stay on him about it.

Agree with everyone on here....call the GM and if he bitches DEMAND to speak to the owner. If he still isnt flinching tell him that if he doesnt agree to the sale within 48 hours he will be hearing from your lawyer and ebay about the dealers business practices. Just what I would do...good luck.

they refuse to sell me the car. thus far I've only filed with Squaretrade and Ebay to complain. I am getting some advice from an Emory Law School professor on contract law.

I'll update more later.

there is nothing in the "details of bidding" that say anything about refusing sale after aucting has ended. it does say they can befre the aucting ends though but that makes no difference.

Funny thing is, I've seen how our boy civic4982 works. He will get the car for the price he won it for, sell it for a 7K to 8K profit and go buy the CL-S 6speed he was gonna get anyway. I'm rootin for your man! Make them sell ya the car!

call your local news station that has a consumer help program and see if they can help. with some luck, your story gets run and the "stealer" gets shamed and bad publicity.

haha maybe another CLS but with nav this time ?

but yeah just filed wit better business bureau tonight also done with squaretrade and ebay ike I mentioned above.

next for me is to speak to a consumer protection part of a news station around here somewhere. I doubt that they'll help but worth a shot.

I'm gonna have to see how much a lawyer costs. I may go ahead and do it but only after I've exhausted all other possibilities.

I'm going to call the VP Carolyn Towbin tomorrow and talk to her directly.

I spoke with the VP this morning she said that they do not have to "accept your bid" on this auction. I.E. DEAD BEAT SELLERS.

I will take this to court next.

i would avoid putting this all over the web for as long as possible, it will only create headaches when people are at the dealership harrasing the salesman and what not.

Get a lawyer-go from there.

Well I haven't spoken to any lawyers yet but from my online research it seems since I have not taken any damages nor loss then I really do not have a case. This is a really shitty situation but I don't know if even a lawyer can win this case.

Any ideas?

Civic, I would still call that lady and tell her that you have spoken to your lawyer and see if she bites. If they know you have a lawyer and are threatening them it might be a little different even though you dont have one.

This should work because EBAY auctions work as contracts, and they have broken their side of the contract as they are refusing to sell you the car. It was their fault they didnt put down a reserve price.

well I went ahead and talked to a few lawyers and even checked out forum.freeadvice.com . the guys there and on ebay forums say the same thing. file BBB, ebay complaint, and squaretrade then take it like a man as a loss.

because of the complications it's really not worth it to go after this car dealer.

yes this will happen again to others and they will still be powerless because of the laws across states to enforce breach of contract. I will spend thousands on a lawyer to actually go to Nevada and sue them and in the end I'll probably lose due to the fact that the court cannot force them to sell me the car or rather will not. Nobody cares and I suppose I've done all the research I need to realize that.

This is the last time I purchase a large item from ebay again.
