Getting sued over minor car accident in TL
one of my friends is getting sued over a car accident that happened in august 2010. it was a small accident that didn't leave a scratch on either parties bumper so he didn't call the cops to file a report. he just got a letter from the persons lawyer suing him.
he should just notify his insurance right?

He should definitely call his insuance and make them aware of the situation, thats what it's there for. I hope it works out well for your friend.
TheChamp531 makes a very very valid point. A lot of the time if no one is injured, at least from what I and friends have experienced, cops will not show up but at least they have a record of calling.

So the cops or insurance on both parties were never notified about the "accident"? If this is the case, can't he easily deny the occurance? Sounds like a bunch of BS from the person sueing...

i dont get it, police reports arent required or anything, and it's not like he did a hit-run. Both parties insurance companies should have handled the entire thing (and if he was injured, pay for his injury).

This is small claims. I am 99% sure the plaintiff will not know what Acurazine is.

Highly doubt an attorney would contact him if it was a "small claim".
Too many possibilities to speculate, but I would get the attorney's name and who he works for/with. If they exchanged information; Insurance etc... then I would contact my insurance company and see if they have heard from the attorney. Insurance companies tend to have "deeper" pockets. So I dont see why an attorney would contact him directly.
You say there was no damage to either vehicle involved, then what was the letter stating they were suing for?

ok so, since you didnt PM me i'll post it on here. it depends on what insurance your friend has, if the insurance covers medical claims then your insurance will take the hit as long as its not over the limit. for example, i have 15k coverage for medical claims so as long as its below that, i wont have to pay anything. if your friends medical coverage isnt very high, then he may have to pay out of pocket, depending how much medical damages the other party is claiming. however, if the other party wants to claim more money than his insurance is willing to pay, then he will have to sue your friend directly for the reimbursement. i had a car accident about a year and half ago and the other party(clearly unhurt) claimed 35k in medical bills. however my insurance decided to cover it anyways even though my limit is 15k, so your friend may get lucky too.

If you want someone to PM, I'd suggest user ComptechTL327, or something like that. IIRC He's an insurance adjuster, and you'll probably get the best advice from him.

Your friend will need to: 1) tell the insurance carrier when and how he received the paperwork, 2) give the paperwork to the insurer, and 3) let the insurer handle everything thereafter.
The insurer can decide to settle the claim or retain a lawyer for your friend to fight the claim, etc.

no you're making 0 sense. i never said small claims court. why would i even bothering posting here if this was about small claims, i was referring to this matter as if it were big money matters, which i have experience in.
