DUI Question
DUI Question
I and my friend were talking and suddenly got curious about this.
1. If I wreck my car when I'm under influence, would insurance still cover for the damage? Of course under the assumption that I got busted by cops and insurance company knows that I was DUI.
2. How about if I damage the other car or property? Would insurance cover for both? neither?
3. If you get busted with DUI, the usual case I heard was you get held in jail until you get sober next morning. Is it considered as serving a jail time and going to follow you as criminal record (when applying for a job, background check, etc)?
I mean first time violaters usually get away with fines, maybe license suspension, but no jail. My guess was those few hours you were in jail after getting busted are just 'temporary', not really serving a time.

1 and 2- most likely insurance will not cover.
3- not sure about other states but in GA the 1st offense is a misdemeanor and does not go on a criminal record. Your few hours in jail do sub out the jail time for your sentence unless the judge wants to be a dick and send you back. However multiple offenses, at least in GA, will make it a felony.

so if mine gets hit by drunker driver's, I'm screwed. Oh wait, my insurance should cover for mine.

Convicted drunk drivers will have a subsequent criminal record. Contrary to popular belief, a drunk driving conviction may remain on your record forever unless your state allows it to taken off (expunged). Therefore, it will appear on your record for employers, credit bureaus, and government agencies to see. The police practice of maintaining records of convictions is an issue independent of how far back the prosecutor can go to allege “prior convictions” against you to increase the penalties if you are convicted.

Unfortunately I speak from experience. I totaled my car (new VW GTI) back in 99. Insurance covered my car, I actually got more than I paid for it, then dropped me. Lost license for 3 months as part of the ARD program, record is expunged after 1 year, driving record cleared after 7 years.

It's a program first time offenders can enter, as long as they meet certain requirements of the program. Such as you had a valid license and insurance, you didn't get in an accident, you didn't hurt anybody, you didn't have drugs or weapons in the car, you didn't have minors in the car with you at the time, etc. It is not a guilty plea. After one year on the program without messing up you can get your criminal record expunged.

This is true... I went through this many years ago. Granted your premium will sky rocket like no tomorrow... but they will cover it.
and it WILL stay on your record for life. Lesson learned. Dont drink and drive!

I've had a few friends who got in accidents while drunk and insurance covered them all.
i was in a dui car wreck. just had to spend monday-wednesday in the county jail here, NOT FUN. insurance did cover everything but they dropped me because i had quite a few tickets prior

Insurance covered me, and paid to repair the private fence i broke.
DUI is on my driving record for 3 years. Class B mistermeanor. Insurance now costs me about $2,500 for 6 months.
Also have to pay $1,000 year for 3 years to the state of Texas (just cuz they can).
I did not have to post bail, judge let me out. Got a $500 fine and 32 hours community service, plus 9 months probation.
With lawyer fees and increased insurance premium- DWI will cost me around 20K.
