diminished value paid in Ontario?

hello,

does anyone here know if diminished value is paid out in ontraio canada?

my brother got into an accident in this nissan.
it wasn't his fault, 100% the other guys fault.

the suv is a murano, bought it for 50k OTD.

the repair was 21000.00, so insurance won't write it off/ total the car.

he went to a honda dealership and was thinking about getting the accord, and was quoted 22000.00 for the nissan.

its an 04 with 22000km on it. virtually brand new.

i was so pissed.

now, he is stuck with this, althought it was repaired, but i feel bad becuse its worth less than half of what we paid for.

insurance is with cooperators.

any advice would help.
