Caught speeding bad what should I do?

I was taking my girl friend to pick up her car in the shop on a Friday and I didn't have any school that day. I was almost home and was first in line at a stop light and was like I am just gonna gun it and see how fast I can get up to. So I floor it spinning the tires and everything. I get it up to about 110 in 4th gear then let off. I start riding the brakes and as soon as I start on the brakes a cop comes over the hill and I'm like oh shit im screwed. Well he makes a u turn but doesnt turn on his lights. I slow down to the speed limit (45) and assume that he is going after someone else. Well about a 1/4 mile later he catches back up to me and turns on the lights I pull over immediately and wait. He comes up to the car and asks me why I was running and I was like wtf i wasnt running but i kindly told him you did not turn your lights on and I had no reason to run. He was like w/e and went back to his car. By this time 2 more cop cars had shown up. After waiting for him to come back with the ticket he gives me the the ticket saying that if i didnt run I would have just gotten wreckless driving but instead he gave me speeding 77 in a 45 and tempting to elude a officer.... My court date is 11/21/08 any suggestions?? This is my first ticket and I am 17 years old

It doesn't look good buddy. Judges 95% of the time believe the officers in court and when a young male is involved that number goes to 99.9% of the time. Unless you have proof (which it doesn't seem like you do) you might just have to chalk it up as a learning experience. If you have access to a lawyer maybe you can get the charge reduced, or get as many extensions as your allowed to and hope the officer doesn't show up in court and then the case will get dismissed. your royally fawked so bend over and take it like a man ... honestly bro seems he took it easy on you. He could have written you up for all three, wreckless, speeding, and attempting to elude. Even so, wreckless and attempting to elude would be worst then your speeding and attempting to elude... there is really not much you can do besides get a lawyer, otherwise than that given your age and the caliber of offense its quite possible you may lose your L's or possibly since it's your first offense, the judge may have some mercy on you. If you manage to wiggle your way out of this with your L's, you'll probably have some hefty fines, traffic school, and insurance will be happy to stick it to you and your rates will be utterly ridiculous... otherwise than that, make sure vtec doesn't kick in again yo! or you will be ... again... not worth the hassle. I would really not wanna lose my license that would make me lose my job make me have to take the bus and make me eat in the cafeteria everyday also would not be able to take girlfriend out anywhere. Anything i can do to avoid losing my license?

If you got the money try and get a lawyer. I have been in a similar situation before and I got a lawyer and I didn't have to show up to the court. Plus it was not on my record and my insurance did not go up.

so far i've gotten about 8-9 tickets, and none of them are on my record.
and all of that w/ in past 3-4 years.

Well wait a minute, what the OP was doing may not have been the smartest thing, if he didn't try to run from the police, he should only be getting a speeding ticket.

My advice would be to get a lawyer, it sux, it's expensive but your 17 and could use the help.

I wrecked a car when I was 17 going 105 and ending up on the roof in the woods. I went to the police myself after the accident (there were no witnesses) and they charged me with speeding and driving to endanger (DTE is a criminal offense) so I got a lawyer. Ended up with a $50 dollar speeding ticket and court costs and the DTE was continued without a finding for 1 year.

On a side note, I find it funny how your avatar talks about speeding and you were just caught doing it.

Now, as for what to do, get a lawyer and have him do all the talking. Its going to be expensive, however remember that you can go to a few of them and ask for prices and if they know the judge. Oh and ask around. Someone has dealt with that judge before and can tell you whether or not he is cool or not. I have had a few cool ones where if they liked the cop, they would work with you to lower the fine but still make you learn the lesson. Also, those same judges, if they hate the cop (it happens), then they will throw your case out and you are not guilty.

I got my speeding ticket (which it wasnt me speeding but rather the trucks next to me) reduced from 75 in a 55 to 60 in a 55 which came out to $110 in fines. $300 for a lawyer and NOTHING on my record which was my ultimate goal.


P.S. I'm sorry to the Police Officers on the board, however, there are some real asshole cops out there. I have had my share of dealings with them and when you know your rights, and what to say, they cannot win.

Second, you have to make sure you're fighting the right battles. From your post, your troubles are two-fold:
1) 70+ in a 40+ area
2) attempting to elude a police officer
-These are the two counts you are fighting against. Go read the wording of the law that has jurisdiction in the place of the alleged crime. See if you can find any holes in it.

3rd, recall your high school government class and try to remember the credo of our justice system: innocent until proven guilty. This means the state has to prove YOU guilty beyond a reasonable doubt - not the other way around. You do not have to prove your innocence, the police officer and the state has to prove YOU guilty. In other words, they have to satisfy their burden of proof.

4th - burden of proof is the main issue here. How is it marked on the ticket that you were speeding? Radar? Laser? Observation?

If by radar/ laser, declare yourself your own council. Then you can then fill out the necessary paperwork and file a request for discovery - giving you access to the police officer's radar/laser unit. If the unit's regular maintenance schedule is off by even one day, your case will be dismissed in the interest of justice.

If by observation: there are many ways to cast a "reasonable doubt."

To counter the charges of "evading a police officer" you must look in your local ordinances what that means by definition.

You need to give more details. If you do your due diligence and re-post all the missing details, I might give some advice if I get the time.

The law most likely says that you are eluding if you fail to stop after being given some sort of indication that you are supposed to pull over. If the cop didn't give such a signal then that charge is meritless. The cop's turning around and coming in your direction doesn't qualify as a signal.

I suspect that when the cop turned around he had some expectation of catching up to you in some certain period of time based on past experience, and you were going faster than usual so it took him longer to catch up with you and he thinks he's a regular Sherlock Holmes and decides that this means you must have floored it after he passed you by. I also believe he gave you shit because you're 17. He thinks kids the today lack discipline and respect.

You must get a lawyer because the punishment for evading police might be severe and I don't think you will be found guilty of that but you don't want to screw around.

If I were you I would be outraged that a cop would try to pin something so serious on me with such sketchy evidence; you didn't even pull off onto a side road let alone lead a high speed chase. I would ask my lawyer about what can be done about this cop leveling a false charge. For you or I it lasts forever but it's just another traffic stop for that dubious cop. I would take it very personally.

good luck man i was caught speeding in a 45 zone exactly like you, the light turned yellow so i gassed it alittle so i could pass it, next thing you know i see flashing lights and im like shit. He says i was doing 70 and tahts what he put down. I went to court and got my liscense suspended for 1 month !! bastard said i was doing freeway speeds and even worse the cop gave me a little smirk after we got out of the courtroom. With the charge of eluding a cop most likely you'll have your liscense taken away for a little bit man. Just take it as a learning experience as I did. I never speed anymore after that it was a living hell for me. Oh and btw i was 17 then as well.

Not in traffic court. Once a ticket is issued, the officer is already swearing on record that he witnessed the offense. He doesn't have to prove anything.
The offender has to prove he did not commit the offense, or had mitigating reasons to commit the offense. Or fight it on the basis of traffic code.(wrong code, or mistakes on the ticket etc)

I would say fight the eluding charge if you can. Talk to a lawyer.

Aside from that, you're lucky he didn't clock you going 110 because then you would be royally screwed.

You're 17, and I can't say that I never speed. But there is no reason to be going that fast in a 45 mph zone. Time to decide if you want to be cool, and drive fast....so simply be allowed to drive.

yea you are really lucky that you didn't get caught going that speed because you could of gone to jail. Now find a way to get a lawyer and work it out because your insurance is going to bite you in the ass if you don't get that resolved.

When I suggested 'owning up to it', i meant go through the process...do what you can to get it lowered...but just as I said. Own up to it.

Of course you shouldn't ever admit anything to a cop if you care about fines.

Where I was coming from though, is these threads get really old...really fast about people who got speeding tickets and or simply asking everybody "HOW DO GET OUT OF THIS!?!?"

Make more sense? Maybe I should've worded it better.

Yeah, the eluding charge is meritless but you'll still get suspended I bet for 77 in a 45. Especially as a 17 yo. Good luck and find safer places to speed....
