I remembering reading all those threads about the crash. Its sad.

But i dont think his wife is doing the right thing.

Would you guys want your wife to sue if you sat passenger seat on a track and didnt make it?

I guess thats better than going after Ben Keaton's family.

The article said they are sueing the Keaton estate... so they are going after the family too.

THE CLAIMS

The lawsuit asserts a number of claims against several defendants. The more significant are:

• Keaton Estate - Failure to inform Rudl that he had been having handling problems with the Porsche, and that he had a recent incident where he lost control of the car.
• Racetrack owners and operators - Maintaining an unsafe racetrack as a result of inadequate maintenance, signage, and safety controls, and not moving back the concrete barriers after creating the children's play area.
• Ferrari Owners Club and the flagman - Negligently operating the track day by sending the Ferrari onto the track at the wrong time, violating their own rules by allowing passengers in the cars, failing to disclose Keaton's dangerous driving propensities, and allowing the track day to occur without moving the concrete barriers back to where they belonged.
• Ferrari driver - Not paying attention to the flagman, entering the track improperly, driving too slowly, and moving directly into the path of the Porsche.
• Porsche - Product liability for selling an unsafe car. This falls into three levels of defect.
1. There was some mechanical problem with this particular car that made it handle badly.
2. There are design defects with the Carrera GT that make it a poor-handling car, mainly tail-happy.
3. Third: The Carrera GT is too difficult a car to handle at high speeds for the average driver without instruction.
My bad. Thats even worse.

Dont these guys all sign waivers though?

^^ yeah, and people who drink and drive and then crash can start suing auto companies because the car's design is defective...it wasn't safe enough to be operated by drunken drivers.

It's totally lame to go after the manufacturer because you're too incompetent to learn how to properly drive and handle a car of that kind of power.

It annoys me to no end that people have such a hard time accepting responsbility for their own stupidity.

I do think the McClellan has some good points.
Like super rich people should be taught some things before they are let loose in such cars (mabee a different class lisence). YES we can sue the government too!


Still don't think it should be in a court though.

Still don't think it should be in a court though.
I agree that the super rich should be taught better skills, but it should not be the responsibility of the manufacturer to provide it. If they do, that's great, but if not, the buyer should accept that it is his/her own responsibility to acquire the necessary skills to properly drive the car.

Probably one day, Exotic car companies might stop selling cars to the US because they're getting sued by gold diggers.

Sounds like this bitch, and her attorney, are looking for $$$

1) Her husband made a choice to ride in a dangerous car at a very dangerous rate of speed. He had the option of riding along or not so the Keaton family should not be blamed.
2) Porsche simply sells the car to the consumer...they do not tell each owner how to drive their cars. If this was an everyday accident when doing the speed limit fine.....testing the "limits" of a Carrera GT around a track is not everyday driving.
3) If he signed a track waiver than he fully understood what his liabilities were that day. Apparently this bitch has never gotten the memo about how relieving others responsibilities works.

It was a tragic loss, it really was. However, this lady should be flogged and burned at the stake for the sheer stupidity and greediness that she is displaying. Things like this make me ashamed to be an American. We have become nothing but a Nation of pigs.

This is a real shame that the family is being sued, Ben was a great guy.


FYI, the lawyer that is representing her is the same guy that sued porsche back in the 80's for all the accidents the tail happy 930 had.
