Car Repair Shop Lends Customer's Car To Another Customer

Norwich (WTNH) - A Sprague man said he brought his vehicle to an auto body shop for repair and received a call from police saying a woman was arrested in his car for DUI and driving with a suspended license.
Michael Meadows says Pro Car Care, of Norwich, did fix most of the damage from a recent accident but he never expected Enfield police to call him last week to tell him a Windsor Locks woman was arrested for DUI and driving with a suspended license in his car.
"At that point they said it appears the car was loaned out from the body shop at Pro Car Care in Norwich to another one of his customers," Meadows said.
But Meadows never gave owner Mark Bogue permission to do so.
"He said he made a bad judgment call," Meadows said.
And now Meadows wants him to make it right.
"If I bring my car to you to have it fixed you have no right giving my car out to another customer," said Meadows.
Meadows says the lock assembly and tail light still haven't been fixed and there is new damage.
"I decided to call [News Channel 8] because I've seen you guys go out and do these investigative reports and I trust your news team," Meadows said.
Not only does Meadows say there is new damage to his car but he also says more than 600 hundred miles had been put on it.
"I don't feel as though I'm getting anywhere with him. He's saying 'I want to make it right, I want to make it right' but when I brought to him there's additional damage done to the car now, he just kind of dismissed me out of his office," said Meadows.
News Channel 8 went to Pro Car Care to find out what Bogue, the owner, had to say but he was not there for comment.
Meadows said Bogue received more than $2,200 for the original fix.
Detelj: "Will you let him fix your car again?"
Meadows: "Absolutely not; he's not gonna touch my car ever again."
Meadows now wants Bogue to pay another shop to do the work.

Seriously? This guy isn't a dealership and doesn't have a right to loan out cars. If the owner had wanted to do that woman a favor, why not lend her his car? I can't believe this guy still wants his car repaired after an accident. I'd want a new one even if it happens to be used.

Exactly, I hate frivolous lawsuits, too. But this guy deserves it, and according to the comments below the article in the link, it seems as though he's not well liked in the community. Seems to me, he needs to be taught a lesson.

It happens way more than you think guys. When I had my benz(older 94 c class), my mechanic would always lend me different cars..... I figured it out when I picked up my car one day & the original owner (of the loaner car I was driving) was pissed at me for driving her car. He (the mechanic) tried to play it off saying that I was test driving the vehicle for him..(WTF) I was so dumbfounded that I didnt say a word. I have long since sold my benz.... WIERD HUH (one of those... did that just happen? moments) never went back.

These idiots who think they can fail to take responsibility for themselves, do stupid shit and sue whoever owns the property or item that caused them injury and distress. I'm sure there are those who are in it for the money and/or attention that comes with it.
Case in point; here in Portland a few months ago, a 7 year old boy was playing on the railroad tracks, got hit by a Union Pacific freight train and his foot got cut off. The family is now suing Union Pacific because there were no signs saying he couldn't play there. I mean......REALLY?!?!

Without knowing the specific facts I don't think that is frivolous, as these types of lawsuits are pretty common and the liability has more or less been settled for some time.

I'm sorry but if you're too stupid not to know railroad tracks aren't a playground, you should be removed from the gene pool immediately. I saw the family on TV, crying about how this evil company's train destroyed their little boy who was just out innocently looking for a place to play.

I have loved trains from the time I was 3 and never did I go crawling around on them. Even before age 7 I knew that it was a pretty stupid idea to play on the tracks. Although I suppose not everybody's a winner...

Ok. Suppose he doesn't have the same fascination about trains as you have - you still have to treat the 7 year old as a 7 year old. Hell, most states have statutes that still hold parents liable for certain actions of their kids until they are 7 or 8. The point is that the law recognizes a remedy for such attractions, especially with kids of such a tender age.
You might want to blame the parents or what not, but the fact is that the lawsuit isn't frivolous. If you have a problem with it, start writing letters to your legislators.
You might think that your parents would have been ok if you had been injured in similar fashion (whether around trains or a mine pit or something else that you could not have appreciated at an early age), but I really doubt they would have let it slide.
It might be a dumb lawsuit, but it isn't frivolous within the scope of the legal definition. Especially when you are dealing with something as interesting as trains.
