Asking Rhode Island Owners with Tints

Asking Rhode Island Owners with Tints
So my friend and i both have 35% tints on the side and rear windows.
My friends state inspection is due this month, and he brought it to his bmw dealer that he goes to. They would not pass him because of the 35% tints. But they also wouldn't fail him, so basicly he has to find someplace else for the state inspection.
They claimed that since it wasn't factory tint they couldn't pass him, even though some cars have darker than 35% tint from the factory which they will pass only cause it is factory tint. I just don't understand how the dealer could get in trouble with the state for passing him, since there is no record of when the tints where there and the only way anyone would do anything about it would be if a cop pulled him over for them, and mostly likely its just a ticket. The cop isn't going to ask who passed your state inspection with those tints on.
Now, we have both had these on for about year now, never once has either of us had a problem with cops, state or local.
So my question is anyone in RI with tints have had this same problem or know any smaller garages that would pass a car with these tints without any issues that a dealer would have.

A smaller garage would probably be your best bet, one of those shady little places.
A dealership might not want to risk passing it since you could, but very unlikely, be part of some sort of sting. They don't want you to get pulled over, the cop ask, and have you accidently go "Yeah, they should be legal since the Inskip dealership gave me my inspection sticker with the windows tinted"
Where abouts in RI are you? I'm down in Bristol

i'm down in newport, i'll have to deal with this next year when my car is due for inspection, so who knows inskip may pass it, but my friends beamer is due this month and his bmw dealer on the island here wouldn't so now he's gotta find some shop somewhere that will do it, so just trying to get some info for him ,and for myself for next year if inskip won't pass my car.
just seeing if anyone has any experience with a certain garage in RI and has tints
