Accident Question

Accident Question

So, yesterday i rear ended someone who slammed on her breaks because the guy in front of her stopped to take a left on on NO LEFT sign. The guy who was taking the left turn turned left and jetted off. We both tried to get the number plate of that guy, but we couldn't. Is there anyway to fight this? There was little damage to her car, but my front bumper right side was damaged. It is only on the right side because i climbed on the side walk to avoid hitting her.

I am assuming the insurance is automatically blame me. But, it was unavoidable.

I don't know about your state, but I'm pretty sure that in most states if you rear end someone you are automatically at fault.

Highly doubt it. They could've stopped for a squirrel for that matter and it wouldn't be their fault.

Ultimately, it's your responsibility to maintain the proper following distance and speed that will allow you to avoid collision. Not to sound like a stick in the mud, but having been rear-ended NINE effing times - some at stoplights, but mostly when I had to stop to avoid a situation very much like you describe - I feel it's an important thing to understand.

It sucks that he did that, and I've passed turns that I felt it would have been unsafe of me to slam on my brakes to make (mostly when I see someone on my ass), but again, it's your responsibility.

The lady offered to not go thru insurance at the accident and we exchanged numbers, but now she is saying her husband wants to go thru insurance because the car windows are not opening. I don't know how the frikin windows got screwed up. I am thinking he is trying to fix other car issues.

Not necessarily. If they stop short for no reason they can be found at fault.

It doesn't matter if it's a good reason or not to stop. Ultimately the person stopping when they shouldn't be can get a ticket themselves. That said the person following is ALWAYS supposed to be able to stop without hitting the person in front of them in any situation. End result being that even if the person in front of you got a ticket your still at fault.

The problem is you rear ended someone who stopped. That will probably put some of the blame on you because you did not have a safe following distance.

Ultimately, it's your responsibility to maintain the proper following distance and speed that will allow you to avoid collision. It sucks. It happened to me too once but I stopped just by few inches short from a newer Audi A6 in front of me because a jerk decided to go left on NO LEFT OR U TURN sign in his brand new Mercedes C class..

I would say deal with it without insurance because you have more chances to be found at fault because you don't have any witness and that lady and her husband can make up any story...that's what I think.

It's not question he will be found out at fault.

Also at this point if there aleady making up stories your better off going through insurance for your own protection. Hopefully you don't have any real ticket/accident history and it won't effect your premiums.

AS has been pointed out, it WAS avoidable; you didn't maintain proper following distance so you could safely brake. (yes, they are BRAKES, not BREAKS)

I also agree with others that insurance is the way to go if you don't want to be haunted by this later. Nothing prevents them from coming back to you later saying "oh, now THIS is broken but we didn't notice before" and requesting more cash, so go the proper route this time.

Help!

My bro was in an accident recently. He was backing up, some guy was coming around the corner, so my bro stopped but the guy continued and hit him.
Insurance says it was my bros fault because he was backing up. I thought it was bull, we were stopped and the guy hit us. It was only 5mph accident. Now that fucker is saying he is hurt, and also trying to get $1500 for damage to his car. His car was a 1990ish eclipse. Total piece of shit car. I think he purposely crashed so he could get some money. Is there anything we can do?

if your bro was cited not really. it's a sue happy society.
file it on insurance and hope your rates don't go up. and get your car fixed if any damage occured to his ride.
if y'all didn't call the cops and no one was cited i'd call your insurance agent or insurance company explain to them why you feel it's B.S. (BUT CALMLY) and go from there.
