2 new tires on an SH-AWD TLX

We just bought a 2020 TLX SH-AWD with 13K miles on it. The car is Acura CPO and has all 4 ties with approximately 8/32 tread depth.
I then noticed that one of the tires is W-speed rated (other 3 are V-rated) and another tire has a small (cavity lie) damage on the side wall.

According to CPO requirements all tires should be of the same speed and load rating and with no damage. The dealer is willing to put 2 new V-rated tires on the car.
Should I accept this solution? I believe these tires tread depth when new is 10/32. So we are talking 2/32 difference between front and rear tires.

Will it cause issues to AWD system? Please advise.

A 2/32 difference will be fine. Put the new tires on the front.
