Fender Gap..?

Fender Gap..?
I just purchased a CPO 2009 TL Tech with 40k miles on it. Exterior is WDP. The car drives great and I love all of the tech "goodies" in it. I moved from a 2004 TSX with Nav, so this is definitely an upgrade.
I'm very careful when purchasing cars... so I'm shocked that I missed this, but the fender on the drivers side has a slight gap, in other words it's not flush with the door. The carfax was clean, but I know that not all accidents are reported on the carfax report. I work for an insurance company so I ran the reports for the car, which pick up minor claims that aren't always reported to carfax, and there were no claims. Furthermore, I washed the car and looked at the color and there is no difference in color on the fender vs. the rest of the car. I also looked underneath the car to see any signs of damage, but there isn't any(remember, I work in insurance so I know how to tell if there was damage and if repairs had been made).
This is my second Acura that I bought from the same dealership, so they told me to bring it back in and they think that it could be that the car came out of the factory like that and they can adjust it.
What do you guys think? Can the fender even be adjusted? And I have read in the forum about the drivers side door not being aligned correctly...which seems to be the issue with the early build 2009's.
