Exclamation Keyless Access System woes

I've had my '09 SH-AWD TL (w/tech package) for a few weeks now, and I'm noticing a consistent issue with the keyless access system. Every once in awhile, about 15% of the time, it flags me as driver 2 instead of driver 1. Since there are a ton of settings saved to each driver, this results in my settings being incorrect:

side mirrors
seat
XM preset
bluetooth paired phone
and maybe other stuff I haven't found yet

Anyone else having problems with this? It isn't an issue with a cell phone being too close, I've had it happen even when I don't have my cell phone with me. It will happen with the keyless unlock, or even when I use the device to unlock it from far away.

Ah, welcome my Californian brother. Yeah area! Take it back to the dealer and they will reprogram the keys. When they took apart my electrical to fix a bad multiplex, I lost my FOB (key) identities, and they both said Driver 1. It takes a half hour or so to reset them.

By the way where is the other key when you enter the car?

thanks.

It's in my backpack, I forgot to take it out and put it in the file where I keep my car stuff. I don't always have my backpack with me when this happens.
