Check the fluid for a brown discoloration and a burnt smell.
On your test drive, pay attention to the transition from 2nd-3rd and 3rd-4th gear for any slippage or jerkiness.
If you wind up purchasing, there are 2 solenoids on the side of the tranny that you should replace. Also, a fluid change would not hurt---search here for both procedures. The solenoids issue was posted by user "I Hate Cars", the fluid change procedures are in the 3G Garage.

Im an 01 with the gen2 trans issues (on 2nd trans) which carried into 04 and 05
sometime in 05 there was a change made to the actual trans case- moving an external oiler installed under recall on the last 7 years of cars..to inside the case
those trans are better but not bulletproof--any car make with similar trans has similar problems
the things listed by last poster are valid--brown fluid is bad
not all will fail, and driving it right helps- avoid using SS mode to do max rpm downshifts into 3rd and 2nd--thats the weak point for heat and leads to failure
I would not buy one now without a trans extended warranty to past when I plan to sell it
anywhere after 50-60k miles is ripe for failure if its going to happen
While some cars go 140 and no prob..eventually it will wear out--they do that~

the car has a 100k bumper to bumper warranty through acura so i am not worried but i will be keeping this car for a long time. i am going to change the solenoids. the car had a fluid and filter change 15k ago at the dealer (carfax). i might stil change it (3X3) when i get it. any other things to look out for in the car?
