'04 TL Trans slow shift in to 3rd

I have searched through the forums a bit but wanted to see if anyone else could lend me some information. I just bought a used 04 TL with 130k miles on it and it was running great until it started to warm up outside. The problem I have is when shifting into 3rd gear from auto or sports shift. If I shift into 3rd while over 5k rpm the engine starts to hit its rev limiter while shifting and then it eventually shifts into 3rd after a second or two. It is only from second to third and it only shifts slow when above 5k rpm. Shifting at lower rpm seems smooth as you would expect.

Is this the trans going titts up on me or is there another possible solution? All of the other gears seem to be okay but I have not really tried to push third gear to redline because I dont have a road that has a fast enough speed limit to test around here.

I just mentioned this in a different thread where my car is doing the same thing but shifts slowly or with a delay from 2nd to 3rd in lower RMP but shifts smoothly in higher RPM.

I tested it in sports mode and tried to shift from 2nd to 3rd and all I could notice is the delay in shift in lower RPM. This started a week ago after I had my transmission rebuilt. Taking the car back to the place where I had it rebuilt to diagnose the problem. I hope someone on here has an answer because the guy that did the work isn't very reliable.
