Well you can view it any way you want.. I think Nissan themselves marketed the shit out of it and they knew the users were going to engage it otherwise the ECU NVRAM wouldn't record when it was engaged and consumers wouldn't be signing a contract stating void of warranty if used. The consumer / driver suffered the consequences but if you can afford a GT-R then you can afford to have it repaired..
I have no idea about a R33 7,000 RPM stall speed.. that's sounds completely ridiculous, it would definitely have to be rebuilt & tuned. I don't know who would get off on that other than someone that enjoys to run their transmission to death and dump on torque & hp... are you sure you're not talking about redline?
No transmission is bulletproof (built or OE) and I think the transmission for the GT-R35 is fine.. but if you run the shit out of it.. it'll eat ATF and eventually start eating the t/c, clutches, bands.. heat & wear are proportional.. the longer you have it running hard & at high heat, the life of the transmission will reduce drastically.
The video didn't discuss the improvement in acceleration with it engaged but it did show that the '10 model runs 3.3 secs vs. 3.5 secs for the '09 model in the 0-60 run, both those runs are with the VDC on / launch control not engaged. Mizuno calls it a 'coincidence' that with launch control engaged, acceleration is better.. that's b.s., another reason why I think this is back peddling to protect themselves.. the owner's manual states specifically:

I mean c'mon.. the last part of that sentence just killed it.. also if the improvement was a faster 60' that little bit of time on the track could mean anything from a car length to a bus length.. just a comparo of 3.3 secs to 3.5 secs from 0 to 60 mph is 8 ft assuming the acceleration is constant (definitely not constant on the track, especially when a turbo is involved, moreso when sequential tt's are involved).. when your right lane is a ZR1.. you need all you got, but if you match up next to anything tamer.. you'd just be an idiot to engage it.

Three Wheelin'
You have a point and people do have there views on this topic...The skyline is a fully built drag skyline so I doubt they care about transmissions. What I was comparing was usually to handle abuse you have to build the transmissions a lot more so they can withstand what you plan to do with it. It was also a manual or sequential trans vehicle either one I forgot which it was. But I see where your coming from...Also supposedly nissan has a separate warranty you can purchase for the transmission issues. My buddies R35 he just purchased that package. He didnt mention the requirements and the cost but there is a "insurance" package you can buy from Nissan to cover the trans. I will ask him more on the details when I get the time.
