You should get some compensation, but don't let these wild claims of new cars and whatnot cloud your thinking. As far as you've stated (if I didn't miss something), no damage was done, just a couple hundred unaccounted miles.

So, what's a couple hundered miles worth? That (plus "pain and suffering") is a more realistic benchmark for your expectations.

- See your lawyer
- Talk to the police. In a sense, maybe a legal sense, your car was stolen.
- Let Acura Corporate know you're investigating legal/criminal action.
- Get the SA's ass fired, if not the Service Manager too.
- Angle for a couple of nice freebies (A-Spec Kit or Wheels or Susp, Lifetime Oil Changes or Scheduled Maint, Extended Warranty, etc).

Aslo, they obviously did NOT go to Newark, CA (one of the navi locaitons) as thats ~400 miles one way. I guess you know that though.

I wouldn't request that... coz you never know what will happen next time you bring ur car in.... eg. put it recycled oil, add metal shavings in ur oil, blah blah blah... hey u never know

but do keep us posted!!!

If you google South Coast Acura another thread with bad experience will come up 5th. That would be amazing if we could get this thread to the top and let people see it when they google it.

legally you can assert a trespass to chattels cause of action. but as other posters stated above your recovery would be based upon the diminished value caused by the joyride, whatever that may be.

Your strongest leverage is publicity: Internet and TV. Give the owner of the dealership an opportunity to correct the tortious conduct of his employee. If he/she does not meet your demands--whatever they are--publish the hell out of it, and then file your suit.

If you don't mind an Acura dealership changing your oil, I'd be happy with free, full synthetic oil changes for as long as you own the car. If you're planning on keeping it awhile and putting some miles on it, this wouldn't be a bad deal.

Don't go for huge compensation. That's what's wrong with this country. Everyone wants to sue people for ridiculous money.

Agreed. 1. Its just a car. 2. Not too much harm to you.

It was wrong for sure, but they don't owe you $1000000.

yeah it's only just a car until it happens to you...........

the OP trusted the dealer to take care of his car and fix the problem, not take his car home for the weekend and drive it like he stole it.......

his trust was violated and his car was stolen by some moron who couldn't afford his own car.......

I disagree. A shop I took my TL to went for a joy ride one time. Came back and it was leaking power steering fluid. I was upset yes mostly about the fact that it went into the shop for an alignment and came out with leaking fluid.

Sure its not a good thing but the OP doesn't deserve a new car for this. It was very inappropriate what the service manager did. All I was saying was that people anymore want a crazy amount of money for something that in the big scheme of things really does not matter.

I didn't say he deserved a new car, my point is it's not only just a car...........most of us depend upon our cars and it isn't right for some hack to take it without permission......

taking his car w/o permission = stealing

at minimum dealer owes him repiar for free + milage at the current rate.......

was the service advisor's first name Michael and last initial begins with an "H" ?

That was the dude who i dropped off my car with and got back the car with the Green Parrot Cafe on the Navi (previous destinations) - They had the car for the weekend because the paint needed to dry so i could not pick it up on Friday.

We are still trying to work with the dealer for a resolution, they are not being cooperative.

I just want my lease terminated without penalty. I no longer want the car.

Thats actually a good thing... A lease.

In this case the long term effects of the joy ride aren't really your concern. If the adviser keeps his job it's a direct indication that the dealership condones this activity.

Did they even fix/identify your initial complaint/problem? One would hope that given 280 miles of diagnostic time they could have narrowed it down and fixed it....

If not, it was complete abuse of possession.

Best of luck

This is the most un-F**KING-believable thing I have heard from a service advisor. What a prik! It's amazing to me how a-holes are just everywhere. To take the car on a joyride is bad, but to treat someone else's car like it's your personal barco-lounger (referring to the food wrappers)? That's fukkin INSANE!

I was thinking that the things you should ask for are:

1) since the prik left garbage and shiit on your seats, a complete detailing by a third party of your choosing - ~$200 I think
2) a decent part/upgrade that you want that's worth $500-1000
3) compensation for the mileage added to your car - I would think $1/mile sounds fair, so about $300

Around $1500 total. You get a lot of free shiit for being wronged like that, and they lose a handsome chunk of change that will hopefully make them prevent this from happening again, but also, it's not so outrageous that you are being overly compensated.

I know this may not matter since you just want to give the car back without a lease penalty. I just had to say something here. (It's not even my car and I'm fuming!) I am guessing the lease penalty is about $1000. So that sounds reasonable to me, but I think your bottom line will be more hurt by it than just asking for some free goodies. After all, you will have to get another car with a new lease, downpayment, etc...

Good luck.

Oh - the other thing I wanted to say was that I recommend you hold off on putting the video on youtube. I know it's tempting and everyone here wants to see it, but if you have to go the lawyer route, those scuzzy-azz lawyers will grab every little piece of public domain and use it against you. I was in a lemon-law suit years ago (for a motorcycle) and they had printouts of every forum posting I made on the issue. It didn't really help them much, but the less you have out there, the less they will have to work with. Obviously, be careful what you write here as well, since they WILL try to use it against you if you end up going the lawyer route.

The dealership is already screwing themselves over by letting there employees take advantage of customers. Bad news travels faster then good news.

Once the dealership leases you the car, the car is the property of American Honda Finance. The dealership has nothing to do with the lease. The Acura dealership can look up the buyout quote on the lease, but if it is early in the lease, there is no way that they would be willing to buy the car from American Honda Finance because the buyout will cost more than a brand new one. Just keep in mind that just because the paperwork was signed at the dealership dose not mean that the dealership owns that paper. American Honda Finance and the dealership are two completly different entities. This is basicly the same as asking the dealership to buy your car for $50,000.00

So after 2 months I've finally put the matter behind me. South Coast Acura wouldn't compensate me in any way, they were only willing to sell me a new TL for $5k off of the sticker. I didn't want to do business with them further so I declined. I loved my TL but it was time to move on. I traded my car in for a CLK 550 and I couldn't be happier.

Thank you all for the advice on this matter and all the other helpful resources the members of this site gave me.

Take care all

Yeah it has dual Arospeed RS Type exhausts on it. I loved the sound I got from those. They were a bit loud though so I had to put the stock mid muffler back on.
