Help: Accident
Hey guys, i need help with an accident. i have never had any accident before and it was my first time today. i was driving slowly and a Mazda mpv van came out from a small street, didn't stop and impacted my front left. now i called the police and they told me there wont be any cops coming unless someone was injured. so i walked to the close station and filed a report. basically i have to replace the entire front bumper, left side fender panel and the left head light. the guy was sort of admitting his fault and willing to pay $3000 without going through the insurance. i was hesitated because it was 100% his fault. i am planning to bring the car to some shops to get an estimated. so what should i do next? file an claim with his insurance company or just get $3000 from him and get it done myself? there's lot going on right now in my mind and i need your advices. thanks![](http://fmn.rrimg.com/fmn062/20120711/1200/large_Umom_55f300000d85118e.jpg)

Glad to see you are OK! Post pics of damages so we can try to help you "guesstimate".. Just make sure the damage is NOT over $3K so if you are taking the $3k and the damage is more then that than you don't have to pay outta pocket. The guy might have a suspended license or no insurance. Make sure you write down his information and all the witnesses information too. Whatever the decision is, good luck to you.

Play it safe and go through insurance. If that's a problem for him, he shouldn't be driving in the first place. The peace of mind and a rental car is worth it.

Take the $3k and run!
I got into a similar accident a few months ago in my 04' TL but only my front bumper and passenger headlight needed to be replaced. The lady that hit me's insurance (Farmers) ended up cutting me a check for $1,016.xx.
From those pics, it looks like you could wetsand/buff out the scuffs on that headlight to save a little cash.

go thru insurance some girl hit me like 3 months ago with beginner license on my passager side front to back came out to 2000 so i rather go thru insurance and get a rental

unless he had 3k in a briefcase right then and there i would go through insurance. You never know if he is giving the run around like " call me tomrrow ill have your money then". Like some have said play it safe go through insurance. Glad you werent hurt though. Keep us updated.

You would be surprised. I had a similar accident where my headlight, front bumper, aspec lip and frnder were damaged and it totaled to nearly 4k. But that included painting and blending the front driver's side door and hood. So there you go.
GO through insurance. Its your safest bet. there might also be damage behind the fender that you will have to be determined by the body shop.
ALso always go to the cops when you get in an accident.

Go through insurance. I'm sure he was saying he would pay it, but I doubt he would follow through. Few people would pay more than what the repairs are. Chances are he will want to pay the 3k in payments, or some BS. Just get an estimate and just go through the insurance. Better safe than sorry.

Goto a body shop now and get an estimate. If under $2k, call the guy and ask for the cash and see how that goes. If it is over $2k, go through insurance for sure.
Not everyone is a low life that doesn't want to go through insurance. Some people would rather pay the immediate out of pocket than to deal with hiked up rates for the next 3-7 years. My wife got bumped by an older gentleman a few years back and he was very adamant about not calling the police and not going through insurance. My wife took pictures, got his contact info and called me. I was very skeptical for sure. Later that evening the gentleman's wife called us to discuss payment. The guy had 2 other minor claims in the past year and his insurance would be dropped if a 3rd one hit. We took the car to get fixed and sent the bill to him which he promptly paid. If this had been over $1500, there is no way I would have accepted this. I think the total bill from our issue was only like $550 since there was only minor bumper damage.

I don't play nice to anyone on the road anymore. Go through it legally with the insurance and notify them. If he wants to go to court, he has the option to fight for it there.

Thanks guys for the great advise and help alot. Btw, does anyone know should I bring it back to the dealer or anybody shops to get an estimates and fix? And what's my best option in term of quality works and piece? Also the guys insurance company is infinity and do they pay for all the oen repair or they will try to lowball me to get aftermarket part?

That will be at least 3k in damages or high 2k. Dont take the money, go through insurance. Some states require you to report accidents over something like $700 to the DMV anyway (i.e. california).
It is in your right to demand OEM parts, if you have to contact his agency directly. I have AAA and they handle everything.

^^your insurance will not necessarily go up. the other guy was at fault which will be determined by the insurance company. a lot of companies have accident forgiveness. if your record is clean, then most likely your insurance will stay the same (rate). you should definitely go through the other guy's insurance since he was at fault and assuming he has coverage.
you could go through your own, and then your insurance would go after his insurance to re-coup the money lost in the claim (subrogated is the term). in this case you would let your insurance deal with the other guys insurance. all you pay up front is your deductible which would be hopefully reimbursed once the claim has settled and YOUR ins co gets money from the other guy's ins.

you have to file with his insurance since he is at fault. but anyone offering you 3k on the spot most likely doesn't have insurance or a license or something. normal people don't offer up money at the scene of an accident

Speaking from experience i would go through his insurance at the first and then if that doesn't work go through yours. I had a very similar situation https://acurazine.com/forums/3g-tl-2004-2008-93/dodge-caravan-1-acura-tl-0-a-855474/
All said and done the total cost for repairs was $10,586.43 now i have since received a check from my insurance company. But cosmetic is not always just what is wrong.

I would go with insurance at this point. As for the rental car issue, isn't it possible for the other party to cover your rental fees? If that doesn't work, find a good friend to take you where you need to go. I hope everything works out, OP.
