I have a sheet metal shop and a lot of different metals to work with namely presumably would be aluminum or steel for under the hood and stainless or aluminum for the rear so my question is could you make your own sway bars?
Are brand name and oem sway bars made to flex or have some amount of give before breaking?

OEM/Brand name sway bars are not "made" to flex. The choice of material determines how much flex you will get. Look up the exact materials that you have in your shop and then look at the materials' properties (Young's Modulus, Yield strength, Tensile strength, etc). That should give you an idea of what material to use.

For example, Eibach uses manufactures their Anti-Roll Sway Bars from cold-formed, high-strength aircraft-grade steel.

Whatever you do, don't use aluminum.

I'm just giving you my engineer's view on this, similar to the view that an engineer at Eibach/Progress/Comptech/etc would have. At the moment, I'm trying to determine what diameter and wall thickness Titanium Grade 9 tubing to use on the control arms of the off road vehicle I'm building. It's not easy....if you want to do it right.

Dont even bother trying. You could make STRUT tower braces but not swaybars.

OP, just get Eibach kit and call it day. Not worth the trouble
