TL-S vs 18 Wheeler

Yesterday my car was parked in front of my work and an 18 wheeler took the corner too fast hit the stop sign and rolled over the back of my car with the trailer. He then kept going. I was thankful for the witness and that he had been making a delivery to a business next door. He was tracked down and when he returned to the site was arrested!. My car is BAD. It was dragged about 15 feet by the truck. The body-trunk was separated from the frame in the back and the frame was bent down. The trunk on the left side was pushed up to the rear window. The electrical system is out too. No power to close the windows or check the miles. I hope they consider it totaled! The adjuster will see it this week. Any Advice from people who have gone through this in the past? I may be finished with my transmission problems

Call a lawyer tomorrow morning. Find out what company the truck was working for, take action. What if you were sitting in your car?

Damn, I want to cry when I read that. Sorry to hear about it. It should be considered totaled. Start shopping for a new ride. Post some pics when you can? Don't forget to pull some parts if you can and sell in the black market.

No don't touch the car. Hopefully you can get a HUGE settlement out of this accident. If you were sitting in the car at the time of the accident you may have been killed. Call a lawyer first thing in the morning.

Damn that's crazy! Well at least you'll get a new car out of it as it sounds as though yours was totaled. The trucking company will probably (should) fire the driver. You really don't have any grounds for a lawsuit except to recover the replacement cost of your losses.

Since he was not injured, wasn't even present when this happened, the only thing he can and should sue for is to recover the damages, anything else is frivolous and one large reason why insurance rates are so high.

well if any mods were done to the car he sould be able to recover some or all of the cost of that ....most insurace compnaies won't cover aftermarket things, but with proof of purchase..depending on if the lawsuit would be worth it he should be able to get that back. Guy I work with totalled his car no more than a month ago and he just had it repainted and got new tires less than a month prior to that and various other things and the other person insurance company would cover it so he's taking them to court for all the stuff he just parchased for the car and they've already made a settlement offer which apparently he wasn't happy with.

Exactly, to recover actual losses (damages) like I said. Attempting to sue for anything else such as "mental anguish" or other frivolous claims is just plain ridiculous.

Anyone can sue for any reason. Weather the courts see it his way though is different.

I was in a hit and run on I95, where a box truck cut me off and spun me around on the highway. I wasn't hurt, but was obviously in the car at the time. Another driver stopped him about a mile down the road. When the state trooper arrived he told the guy that he was charged with leaving the scene of an accident - a misdemeanor. He also told the guy that if I would have been hurt it would have been a felony! I certainly said THANKS to the guy that stopped him. His trucking company covered my damages.

See that is what pisses me off about insurance, you could put 10,000 dollers into your car and the insurance companies only want to give you blue book value. Blue book value is such a crock of Sh*t.

Yeah, but they also give you depreciated cash value for the things that are damaged and they can't replace it.

I will try to post some pics soon. The DA called me today because the guy is still in jail. He had warrents for his arrest and had previous convictions. They asked me what I wanted them to do to him. I do not care. I just want my car totaled. I won't sue, I just quick resoultion to this incident. Yes, I was sad to see my Tl bashed, but there was nothing I could do about it. Everyone at work was sad they said that my car was so nice.

A good point has been made here. What if he was in the car when the truck did the hit and run. I'm sure the truck driver didn't care either way. IMHO the truck driver needs to be taught a harsh lesson about why we don't run other peoples cars over.

If he was in the car and was injured, then I see a shit ton of money out of this situation. And that's totally justifiable and legitimate.

However, thankfully, he wasn't hurt. It's just property damage, which falls under the comprehensive coverage section of the insurance. There's no settlement money to be had from this, except for the current market value of the vehicle. Everyone who is talking about suing is what is wrong with America today, not to mention he has no case in civil court whatsoever. You should be ashamed.

Most of truck drivers smoke meth and crack all the time to stay up for the long drives... I wouldn't doubt he was on something when he swiped your TL. I would definetly sue the truck company or his insurance (if he has it). Just think if you were in the car... you could have been injured.

Sorry to hear about your TL, but aleast no one was hurt. I would sue, you have good grounds too. The truck driver did a hit and run, left the scene of an accident and reckless driving and endangerment along with other charges, some of those charges are a felony. I am not a sue happy kinda person, but you will lose money no matter what on your TL. Might as well get paid for your loss. Keep us posted. Good Luck.

Um, yes you do care. Have them throw the book at him. If this happened to me I would want him to never forget it so hopefully he'll lose his license or think twice about another hit and run.

He should get a settlement from the trucking company (I did when it happened to me). His insurance will never be involved.

I agree in not filing suit unless you have actual losses that they won't pay for, but remember you have a lot of negotiating room now. Make sure they pay you replacement cost for the car (i.e. new car with new mods).

you only get a certain amount of money if your car is totalled right? if anything sue for the difference you didnt get back when you bought it new. so like if they give you $20k (the insurance) sue for $10k or w/e. catch my drift?
