Angry This sucks

So here's the deal.. I left my TL with a good friend to watch while in New Mexico. Today she calls and tells me my car was hit. She claims she wasn't driving it. Should I have to pay for it to get fixed or should she.

Doesnt matter where it was. The car was parked
Your insurance covers your car- comprehensive covers damage to your vehicle, liabilty covers damage to other cars or structures that you run into

Your insurance then goes after the other party- or if you have uninsured motorist coverage, that covers your cars damage if it was a hit and run
Just call your agent and have a few body shops give estimates

there are a lot of factors that come into play.. was the car just hit today?? is it still parked where it was hit? did she have permission to drive the vehicle??

Im sorry but why should she have to pay? YOU are the one that let her drive it. Now if she was doing something and caused the damage she should offer to fix it, but ultimately its YOUR car and YOUR responsibility.

She says it was hit today and its still parked in the same place. She was only suppose to drive it to pick me up from the airport. I won't be able to see it till the 8th of next month and those are the pictures she sent me..

I do have insurance but should I use the insurance and pay $500 deductible or pay in cash so my insurance wont go sky high?

Maybe leave the car where it is and file a police report when you get back in town. Tell them you left it there and it was involved in a hit and run while you were out of town. You shouldn't have to pay a deductible if you weren't even near the car when it happened.

Your insurance shouldn't go up at all because you didn't hit anybody. It's a hit and run so it falls under comprehensive I think.

I think she was joy riding in it because it took her 3 hours after the fact the car was hit to call me. Then she was trying to get someone to fix it before I make it back. But another friend seen it and called me 1st.. So I think somethings up.

Well it would have been nice to mention that earlier. You don't want to get in trouble for insurance fraud for telling the insurance company something that is not true. Then again, maybe she is telling the truth and she was somewhere else and didn't see the car until a few hours later and just wanted to fix the car before you got back so you would still trust her and/or not get mad at her.

That damage doesn't even look all that bad. Can't you just buy that fender, get is painted and installed? Or fix that one if it is fixable. Regardless, I would ask the friend who called your 1st to get more details about what happened without alarming your other friend ( you lent the car too ), that she is speaking to you about it. Like a third party. Good luck.

I dont know what your policy language says, but you may have an uninsured motorist claim, which whould be a $200 or $250 deductible. RE whether or not to ask her to pay for it #1 is she hot and #2 will she fuck in trade?

I don't think that she can claim an uninsured motorist since there is no proof of the other vehicle. As far as the insurance co. is concerned, they think that you probably hit something. The same thing happened to me after I got hit on the highway and the guy drove off. Since there was no definitive proof of a second party involved, they treat it as though you did it yourself.

Next time tell them you will give a statement under oath that you were hit. We handle cases like that and when the adjuster tells me they will deny the claim, i just tell them to take the statment under oath or get sued for breach of contract. They always settle.

Well if she was joy riding it then it sounds like its her fault and make her pay to fix it.
If it was really parked and a hit and run occurred, then report it to your insurance. you have to pay the deductible to get it fixed but no way should you insurance go up.
But right now, i think you need to find out the real story of what happened.

why would you let your "friend" drive your car if she is gonna joyride in it, especially if your not there? some "friend"...

friends are dicks, even if they are really good friends, don't trust them with expensive shit. if its your first wreck in three years, your insurance will give you a freebie reguardless, you pay deductable, but premiums wont go up. if not, it will drop in three years...

Whether you were nearby or not has nothing to do with whether you pay a deductible.

If you have a collision and you policy has a deductible, you pay the deductible.

If you have a comprehensive claim (like this one) and your policy has a deductible, you pay the deductible.

Say your car is parked at the home. You are out of town, 2,000 miles away. A tree falls on the car and causes damage. You're saying you don't have to pay the comp deductible because "you weren't even near the car when it happened"?

I don't think so.

The only way you avoid the deductible is if they find the person responsible and their insurance pays.

You left the car with her thinking she wasnt gonna use it , that was mistake #1 , I would just ask her to go half and then break ties with her afterwards. If she doesnt agree then just fix it yourself and chalk it up as lessoned learned. The time and stress for a situation is not worth it when you can just get it done.

Has any one else noticed how rusty the rotors are? It doesn't look like it's moved for a few days at least. You need to figure out what happened and if there's another party at fault which you can identify, file a police report, even if, or maybe especially if, that person is your friend. If it was a hit and run and you have no way finding out who the other party was you may want to consider just fixing it on your own dime depending on your history with insurance claims. It may just be cheaper in the long run. Plus, if you don't file a report you'll have a clean vehicle history.

It looks like a pretty low impact collision, possibly the result of a parking mishap. The damage looks mainly cosmetic from what the pictures show. If you're lucky you'll be able to get away with just new quarter panel and some paint.

My OEM rotors rusted like that after one car wash, so I don't think you can go by that. Of course, it wipes off after you hit the brakes once.

That's why I don't let anyone drive my car. I would offer to pay for a ride (in their car) to the airport, or I would call a taxi and save the possible headache of something like this.

Oh, and I never leave my car in the airport parking...L.A.P.D gave me a ticket for no front license plate when I left my car at L.A.X for 3 days.

Cmon guys- someone was drunk and backed into a parked car- thats not a driving crash. Any good body shop can look and tell you what happened

The friend may have had it parked in a bad spot and wanted to avoid the headache for the OP by having it fixed or ready to to the shop at least.
Why wait 3 hours- cmon!- do you pick up the phone to tell someone their beloved cat, which you promised to take perfect care of,--has gotten out- and ran in the steet----and was----

No- first you freak out about and and try to find an exact looking replacement cat~

The other way that kind of damage occurs is when driver is parked next to a pole and cranks the wheel while backing out of a space. BANG right at the fender-door pillar every time~

If its your friends responsibility to "watch" the car, she should be liable to get you a police report. Thats just less stress and paperwork you'd need to do when you get home. if you find out she was driving, her insurance should cover her

I don't think thats true. My truck was hit while I was in Oregon, I saw it when I came out of the store, called the police, got a report. I still have to go through insurance and pay a deductible.
