San Jose, Accident Story
I'm so pissed and just want to tell my story. Thanks for reading.
I leave my house and just 2 blocks down, I'm waiting at a stop light over on Snell and Rosenbaum. Light turns green, I look to my left and there are 3 lanes. I see 2 cars stop so I go and then all of a sudden some stupid lady runs the red...
I slam on my brakes with my hand on the horn. She didn't even bother swerving to the left (if she did, she would have missed my car) and hits my car.
Luckily, only the front of my car. Another second and it would have been on my driver's side door and who knows what that would have been like.
This lady my god...gives me this $hitty paper and it half a$$ looks like insurance. There's no policy number, no insurance company phone #, and she's not the registered driver or the name under the so-called insurance. I'm like WTF? There are 2 witnesses that pulled over and they call the cops for me.
She gets cited for running a red and possibly no insurance coverage, b/c the cops don't know if the insurance is legit or not. Check this out, the policy says it's only good for a month and it's like "Gomez insurance company" or some shiat like that.
I'm like, oh crap, that means more than likely my insurance company will be the one paying for me.
So, what advice can you give me on how to handle my insurance company? Who do you think is the best body shop in Bay Area CA? Damage doesn't seem bad, but I think I'll need a new hood, bumper cover, bumper, corner panels and maybe new HID light housing...

sorry to hear about that man, it's really painful. care to tell us where it was exactly at? i am in san jose so i might know where it happened.
and seems like you are having a much tougher time than me...... i really doubt if she has any insurance at all and even if so that tiny insurance would probably give you a very hard time fixing your car. big companies usually do it fast but small companies usually tend to torture you a bit and try to prolong the issue until you bring up an attorney.... (one time happened to my friend. he was hit by anther person running red light, and the insurance asked my friend if he ever felt being a bit at fault... wtf?)
moreover, if i were you i would try NOT to get my insurance involved as much as possible. once the other party's insurance KNOW that your insurance company is aware of the issue they would try very hard to make it deal to pay 50/50. it would be bad coz' i think there is a law saying that if your insurance agrees on 50/50 you can't really argue at all.... so you might wanna check on that.
and yeah check my pm on the shop thing, it should help a bit. and from what you said about the fixes it is probably around 3k to 4k damage....
but it's definitely good that there were witnesses for you so the other party can't say anything about it.

I would take the opposite route. If this lady has no/crappy insurace you're going to have to get your insurance company involved anyway.
I'd just tell them the issue, claim it and have your company deal ewith the other guy. If they get the money back you're off the hook for the deductible and any rate increase.
My dad did that when some lady rear ended and totaled his new maxima. he got a check cut within a week when the lady's insurance still hadn't called him back. his insurace co is handeling everything and he hasn't had tto pay a dime.

Here is my expert opinion, since I work for an Auto Insurance company. You should definitely report this to your own insurance company right away. Since there were 2 witnesses there and Police did cite her for running the red light, there will be no dispute who is at fault. Since the accident is not your fault, it does not matter if your insurance company pays for the damage, they will eventually get their money back by either going after the owner or the owner's insurance company. Plus, your premium should not be affected because this is a non-fault loss.
Who is your insurance company? There are tons of shops in San Jose that are good, just ask your own insurance to refer you to one and make sure that particular shop guarantees the work for the life of the car.

I figure if you have a lot of claims where you claim someone hit you in the parking lot, etc where the insurance company can't go after anyone then maybe your rates will go up, but even that, I doubt it.
Oh, btw, another reason you probably want to go through your insurance company is that the other guy will probably send you to some low ball auto shop that will use low grade parts. You want the OEM parts which is what most good insurance companies require for their repairs.

I'm an agent in MS. Medic and Rominl are right. I would try to contact this lady at least once to see if she can tell you how to reach this company the vehicle is supposedly insured with. If the insurance was recently written it wouldn't have a policy ## yet. But if she gives you the runaround then go ahead and file it on your insurance. Your initial deductible will be whatever your collision ded is but if they find that the car is insured they will refund it to you or if it is deemed that the car was uninsured they will pay under uninsured property damage.

Its possible the other driver had a "binder policy" until the actual policy was issued. The police may be able to help you here. However, many here do not want to go to their insurers if they are not at fault. You're insurers are service providers who will repair you're vehicle, and then go after the responsible party whether they are insured or not. This is not something you want to do yourself.
Regarding repair facilities, call you're Acura dealer. If they do not repair, then they will have a preferred body shop.
