My car...gone... :'(

yes i'm ok, thanks for all ur concerns, i just didnt have time to post til now.

happened tues night, around 10-11pm. i was on the way to go eat wif my gf, and it was on the 10E, where it splits off the 10 and the 5, the right two lanes leads to the 10E and the left lanes to the 5. i went on the 10E and just as i merge on, i change one lane (so i am now in the 3rd lane from the shoulder), and i'm driving normally (like 65mph). and then suddenly the car in front of me changes lanes, and my gf goes "watch out babe!" and right after she said that...*crash* i run head on into this black car stopped in the MIDDLE of the highway, with no parking lights on. airbags went off, and the car came to a dead stop (i guess i stepped on the brakes...) i asked if my gf was ok and told her to get out of the car...onstar called me (but i didn't respond cuz i didn't realize that voice was from onstar until later) and both my gf and i are fine...jus some bruises from the seatbelt, but thats a good thing cuz they saved our lives. the car is now sitting at a body shop waiting to be evaluated by my insurance company as totalled or fixable...oh and there was no driver in the vehicle parked in the middle of the freeway...and no one showed up later either...police said they'll investigate it, so dunno who they gonna blame it on...wut do u guys think? i think this is in no way my fault...i couldn't have done anything, there was no time to react. and i was going speedlimit. and the car was abandoned in the middle lane of the freeway (there is some law that states u need to push ur car to the side of the freeway right?) anywayz im just glad that no one got hurt...its the first car accident i've ever been in, so if anyone has any advice on wut i shud do now, pls tell me. and here are some pix i took after the tow truck dropped the car off at my place (there was no where to drop it at midnight...) i didn't take pix at the scene cuz my camera just happened to be out of batteries well anywayz thats the story!

Hiya Wilz,

Sorry to hear about the accident, that's some pretty bad damage there. Are the police going to write a report about the accident? You might want to swing by and pick it up, then shoot it over to your insurance company. Police reports are usually ready within 10 days. You'll definitely want to push your company to contact that owner of that vehicle.

Now as for liability, I've handled similar accidents before. The important question will be whethere you had the opportunity to see the other vehicle or not. It's kinda hard to tell, I mean it's night, you're going about 65 mph on the freeway, the other car was black, and there was another car driving in front of you at the time. If I were your adjuster, or even the other person's adjuster, I'd at least put the majority of liability on the owner of that vehicle. You also have to look at what the owner of that car did wrong. He left the car in the middle of the freeway, that's an obvious no-no. But were his emergency lights on? Did he do everything possible to keep his vehicle from becoming a hazard to other drivers? Stress those points to your adjuster. Also, check the web for the CA vehicle codes. I believe there're a couple stating that vehicles cannot remain abandoned for a certain period of time.

So those are my two cents, but don't go and quote me to your adjuster

I fell really sorry for you, but glad you are doing alright, wonder how they can fix that? I would be amazed if they could....damn.. and how old was the car?:wow:

sorry to hear that wilz... at lesat you and your gf are ok, that's good news. cars you can always get another one, but lives...

anyway, i think if the hazards of the car in front was not on at all, then they can't really blame you, at least not totally, coz' there was no way for you to react in time.... make sure police report says that and use it against your insurance

keep us all posted about how it goes....

Thank god both of you are okay. That's some scary stuff. I would hope that a lot of blame goes to the person who abandoned their car in the middle of the road.

Let me see if I understand this correctly: Your car colided with a non moving vehicle while you were traveling at 65mph? Ahhhh... no scratches... You got to love our cars... Glad to hear your outcome of this is and will be positive.

again, the safety of the CL/TL is proven! that car is definately going to be considered totalled..no way thats going to fall within the price point of being fixable and not totalled...i cant beleive some idiot would park his car in the middle lane of the freeway, what a jack ass, glad to hear no one got hurt

Glad to hear that you and your gf came out of it relatively unscathed; insurance shouldn't really find that the accident was your fault if what you say is true.

I will say one thing about whether or not the owner of the other car should have pushed his car to the side of the road--I sorta can see why he (or she--in which case one wouldn't expect her to push it to the side all by herself, especially across a few lanes of freeway) wouldn't attempt it because a) he's on the freeway, at b) night, when visibility isn't all that too great, and it's on I-10 to boot--I'm not all too familiar with LA freeways but I would imagine that since I-10 is a major one, there's gonna be more than a few cars even at 11 pm, and heck, it's LA! Think about it--the car in front of you apparently didn't see it until the last moment--hence his sudden lane change maneuver. I wouldn't want to take a chance in moving my car across to the side of the freeway if I didn't think I could do it without risking getting hit by another car, but that's just me.

sorry about the car but glad you two are OK! it looks pretty bad, almost like the accident i had with my 2000 accord, but mine was F'ed everywhere so it was totalled...your's might not be considering the trend with members on this board. anyway, take care.

Wilz, sorry to hear this man. Thank God for seatbelts and airbags. Glad you're OK.
However, even though you are OK, my advice is to go to the doctor as often as possible. And on a continuous basis. When I had my accident years ago, I didn't go on a continual basis and my settlement ended up being much less than what I could have received had I went for six months straight. (Over the 6mos period I went on and off w/a 2 month break in between.)
So, get in to the DR and go back for checkups every few weeks. Any slightest discomfort may play a part in the whole scheme of things.

Wow. Those pictures are scary.

But the important thing is that the two of you walked away from it. Cars can be replaced, but people can't.

I know you love your TL-S, but it won't be long before you've got a new one.

Really sorry to hear about your accident Wilz. Your baby is most likely going to be totalled. Damn, at 65 mph head on collision and look how well the safty cage stayed intacted and crumble zone did its job. I'm glad nobody got hurt in this incident. Good luck and keep us posted.

Wil,

Like everybody else said, glad that you and your girlfriend are ok.... Dont worry about the accident, its definately not your fault. You are in no way responsible. Im sure that the insurance company will total the car, by the looks of it. You should get FULL Value for your car since its the current model. DO NOT LET them under evaluate it. my car is almost 5 months old, with about 10,000 miles...if it was totalled, wut do you guys think the insurance will give me? and will they also consider the price of my factory body kit? (sway bars, springs, air filter, and some other mods all gone )

and about it being too dangerous for the guy to move his car, then at least he could of put on his parking lights so i could of SEEN his car...

and how does this see a doctor thing work? do i hafta tell my insurance first?

and yes, the car is pretty damn safe! no deformations to the driver or passenger area.

Will! I'm so glad that you and you're gf is OK!! I was so shocked to see pics of your car yesterday on acurainspired!! I was trying to call you yesterday, but you weren't answering

I seriously think that it's not your fault. I mean, a car in the middle of the FWY at night with no hazard lights on, and owner of the car fled. I wouldn't have seen it myself.

I'm just glad you guys are okay, and I can agree on how strong these cars are built, amazingly. As for the car, I don't think it's worth repairing. Go get yourself a another TL-S. Talk to your insurance company about the modifications.

A stopped car would be plainly visible (esp with HID) unless you were so close to the car in front of you that you couldn't see past it...anyone else never thought of this?

Dude, glad you are ok. That's the difference between a car with a high safety rating and a low one, you walk away. From the looks of it I'd say it's totalled. Mine was boarderline, and yours has similar damage, just pushed further back but head on, and your airbags deployed, add to that it's a type-s and you're gonna be well into the mid to high 20's. Should be a total. Don't let them work on it until they decide it's totalled or not, if they don't total it, get your own appraisal, it's worth it, if that doesn't work then get a lawyer, but that car should be totalled it looks to me like.

BTW, if it is totalled, due to the fact that it's under 1 year old and under 12k in miles, it should be a direct replacement (you go buy the car, insurance pays the full bill [tax, title, etc]).

It's tough to say. But for those of you that insist on clearing your lenses remember this is the *exact* reason the reflective pieces are in there--to give the car some visibility at night in the case the car is off. Granted, this was from behind and on a highway, so I know it is different, but it gives you something to think about.

damn that looks like a horrible accident... glad u guys are ok... woulda been dangerous without seatbelts. I usually don't wear seatbelts but i'm think i really should.

Seems like u spent quiet a few bucks and time on your mods... see sometimes things like this make it seem like it's not worth spending money on aftermarket stuff... but that's off the topic

hope insurance makes the right choice on your car.

im not that worried about mods...i pulled about half my mods off before i gave my car to the body shop. (only things i couldn't get at like springs and sways i left) the body kit, i dunno...it was installed by an acura dealer...so i dunno if it will be paid for

and as for the comment about the car being visible...it was right after i merged onto the freeway, there was a car blockin my sight of view (so it has nothing to do with my HIDs) and the car was black with no lights on...at night...i think anyone in the same situation would not have had time to react. why do u think the car in front of me pulled out last minute??

Getting out your policy and reading it all the way through would be a good idea before you talk to your insurance.... And if they don't meet your demands for a replacement, get a lawyer. BTW, be careful with the Cali insurance companies, they can LEGALLY lie to you. :wow: If I were you I'd settle for nothing less than an 2003 TL Type-S (color of choice) with a body kit installed and your springs and sways transferred (most insurance companies will only cover $1k in mods unless you have a rider attached to your policy).

Hey Dude, I'm glad you and your g/f are ok. It's miraculous you walked away from this accident. The damage to the car is amazing. I'm glad the safety features of this car did it's job. I think even if the insurance company doesn't total your car and decides to fix it, you should get rid of it. It won't be the same after this. You and your g/f should go see a doctor to be sure everything is ok. I don't think it's your fault either. Take care dude. Let us know what the outcome is.

Isn't it good to know that we are driving safe cars. Glad to hear that you and your gf are ok. The car is probably totaled and can be replaced. But what about the mods? I know your headlights and the fogs did cost you a ton of money. Any chance that you can salvage anything? Since the insurance won't cover that...

All in all, good luck and let us know what the insurance says.

Sorry to hear about your experience

I too got into an accident not too long ago (maybe you've seen pics) but the insurance company decided to fix mine. Total cost was roughly a little more than 20 grand to fix. I use to be soo critical about my car (every scratch and rattle) but now my out take changed. Be glad you were able to walk away...I was.

Regardless, good luck with the case and keep us posted. At the very least we should all learn a little bit of CA law from your accident.

Ive almost hit cops parked on side of hyway before on a dark road, even with my lights, u can see their logos but not the exact edge of the car, something to think about is that maybee the guy left his hazards on but the battery went dead, older cars do that, there could be many reasons why the car was left there with no lights, but in no way should the blame be on wilz, no way, at those speeds reaction time is starting to get small and dangerous
