Angry Had A Accident Last Week...

I was just on my way to work. I was stopped at a intersection cuz i had a red light, So the light turns green and i go, next thing i know is this piece of **** (90) jetta slams right into me and then she just drives off. So it was a hit and run. For some reason i had a cop right behind me and he saw the whole thing. ( the one time i am glad that a cop was following me). So he left and chased her and brought her back to where the accident happened. Turns out she didnt have a license, no insurance and the car wasnt hers. Little garbage ass car she was driving was considered totaled. I love my tl it was a hard ass hit and there was no SERIOUS damage to my car. The one thing that scared me the most is that the accident happened at the same Intersection that i had my last crash in the year 2000 with my Legend...

oh man if I was her right now, i would be sh*tting my pants. Do you know how badly she's gonna get raped for that? especially a hit and run...oh man, she can kiss her driving days goodbye for a looooooooong time!

No thanks, I'll pass. Just looking at this pic brings chills down my spine. Sorry about the accident, dude. Hope you weren't hurt physically. I can only imagine the psychological trauma you're going thru.

Yeah luckily that there was a cop there otherwise it'll be something else to be pissed about that she had gotten away.

I'm feeling your pain Samobs. That exact same scenario happened to me when I totalled my '99 TL-P. You should sue her for everything she has, just because of the fact that she hit your car and ran. I'm pretty sure that it just pissed you off more when you saw her fleeing the scene. :p Good thing that cop was behind you Sorry for your loss...hope your alright.

P.S. If you still wanna meet up before h.i.n....I'm down. Hopefully it'll be worth the $25-$30 you pay to get in

Not to put a damper on things or sticking up for her, but...I doubt that her driving days will be gone for a long time--remember, this person didn't have a license and insurance to begin with, plus she was driving someone else's car--so what makes you think that she won't be driving any time soon? Even with a hit-and-run, odds are she'll probably do very little jail time, if at all...she'll be back on the streets in no time. Yeah it sucks but unfortunately that's how things go these days...

First, very sorry to see this, I hope the laws in Chicago are very firm when it comes to situations like this.
This is one of the reasons why I always look around before I take off on an intersection, even if I'm about to race because of stupid people like this.
I hope you can fix this but if you can't, I hope is so damage that they have to pay your car so you can get a new one, good luck and be careful out there is a jungle.

I'm not sure about Illinois, but in CA, the insurance follows the car. That means that if this had happened in CA, the owner of the vehicle would be financially responsible, not her. You might want to look into that.

Also, tdoh's right, her drive days are for from over. There's an old saying, "you can't squeeze water from a rock". If she didn't have a license, insurance, and didn't own this car, chances are, she doesn't have any money either. Your insurance can chase her to the ends of the Earth, take her to direct collections, and still they won't get a dime from her. Destroying her credit rating is pointless and preventing her from getting a driver's license is as well.

Possibly true, but depending on the circumstances--if I were the owner of the vehicle, if it did have insurance, and if I didn't give a rat's a** about the driver--I'd probably just tell my insurance to deny the claim on the grounds that I didn't give the driver permission to drive my vehicle. Yeah it would suck for the victim but hey, I'm not about to take the hit for someone else's transgressions if I can avoid it.

All of this brings up an interesting point--never let anyone who's not under your auto insurance policy drive your car unless a) he's covered under his own policy as far as driving someone else's vehicle; b) you're willing to take the rap under your policy if he screws up your vehicle; or c) you're gonna claim that you never gave him "permission" to drive your vehicle.

Don't forgt addendums c-1 and c-2

c-1: Make sure the driver agrees with your disavowing his right to drive your vehicle.
c-2: Make sure you understand the consequences of your actions. Insurance fraud is a felony, punishable in CA by up to 5 years in a state pen and a $50,000 fine.

The lady did get arrested right after they towed her car she was put in the back seat of the cop car. She has a to go to trial in mid November. Cop told me i can go if i want but not a must. Good news is the car is almost done will be out of the body shop by the end of next week.

True, but it is a tough choice--save yourself (as far as increased premiums go) and let the person hang in the wind...or show sympathy (saying that you gave permission for the person to drive your vehicle) and eat the soon-to-be forthcoming increased premiums.

Yeah, the former could be construed as fraud but think about it this way--if you gave your friend (or acquaintance) permission to drive your car, he then wrecks it big time, then you find out he doesn't have any insurance of his own and/or the means to pay for the damage to your vehicle (IOW, to put it bluntly--he either can't or won't)...what would you do? Give in and tell your insurance you gave him permission to drive, in which case they'll fix it under collision coverage but raise your premiums...or file a claim under comprehensive (essentially saying that you didn't give him permission to drive your car), where they'll fix it and probably not raise your rates (or maybe raise it a little, but nowhere near as much if you filed under collision)?

Ah, the moral dilemma--save yourself or save your friend...

If you hit another vehicle, it's a collision, no two ways about it. Unless the other person just decides to never contact you, it'll be hard to claim that the accident fell under comp. On top of that, once the physical damage inspector (outside adjuster) comes to see your vehicle, he will most likely be able to tell that the damage was caused by a collision with another vehicle.

Now I have to say that if anyone let...well...anyone else drive their vehicle, I'd hope that they would have the sense to ask for insurance. If not, well, option "c" is definitely an option.
