Angry Crashed Tl

hey

im soooo pissed off rite now!!!!
sum @$$hole ran a stop sign while i had rite of way and we both hit each other... this happend on east freehold and robertville road intersection. good thing i got witnesses. my whole front driver side is ****ed up... both my airbags deployed. and they had to use jaws of life to opene the hood.. OMG i hate that guy.. he hit a pile of snow after we hit and i slamed into 2 other cars. my boy blackac3.2 saw this **** kuz he stopped by..

any legal action liek sueing the $hit outta him? he was in a pickup so his $hit was dented thats it. omg i cant believe dis $hit. by spring i had so many plans!!! dam. i donno if the car is totaled or not. but it sux!!!!!!!

im alrite just devasted.. i shouldve took the road i always take to work but i didnt
2morrow ill be acking.

ill post pics when i go see my car again.

take it easy guys... if my car is totaled ill have stuff for sale.

Damn Mike, sorry to hear that. I know you were looking forward to the spring and the meets.

Since he ran the stop sign and you have witnesses then sue the $hit out of him.

Mike that's truly terrible!!! i'm really sorry to hear that. gosh, it's amazing how things happen....may not sound like much but at least you have your health...insurance will help you out hopefully.

sue, sue, sue. Why is this the answer to everything? It is called an accident for a reason. The car is a CAR. IF you are ok, then be thankful, talk to the insurance companies, and move on.

it just hurts man to see something u really love leave you.

i agree that i should be thankful im alrite and i am but that guy is a complete idiot. accident or not he dosent deserve to be on the road if he cant read a sign that says STOP. im only 17 and this is very devistating to me.

im prob not gonna sue anyway. as long as insurance covers everything if the car can be fixed that is. i really hopeis can be fixed.. got alot of mods wating to be put on..

I understand your anger and frustration. However, as I stated before, it was an accident. He didn't want to hit you. It is true that he should have seen the sign, but anything, ANYTHING can contribute to an accident. What if the sun was in his eyes, or headlights if at night. There are lots of factors. Going by what many people say about the other person involved in an accident, no one should ever drive. Can you tell me you ALWAYS use your turn signal? So many people don't. Have you ever missed a street sign? It happens. It doesn't make you an idiot if it happens. It means you simply missed it. Just stay safe, glad you are ok, and I am sorry for the loss of your car.

Sueing him right now would be a bit premature. In the eyes of most any court I've ever been in connection with it helps strengthen your case if you contact his insurance company with a detailed list of things that you lost. Just don't stop at the cost of repairing your car. There are other expenses such as lost time from work, a medical exam from your doctor to check things out, travel distance to and from your doctor and most certainly a rental car of similar value (not some 2000 Ford Escort) while yours is being fixed if it can be.

If you make a valiant effort to get compensated for these things and his ins. company either won't pay for a just amount, refuses to or won't answer your calls then I would ask them what is the name of the law firm that they are contracted through to handle litigation proceedings. And keep a record of each call you make or receive form him/them.

In my everyday job I see this all the time as I work for a court-reporting firm.

Document all your correspondances with him and his underwriter. If you send anyone a letter then do it by certified mail with a signature receipt coming back to you so they can't say they didn't receive it (costs $4.05 extra per letter). You'll have signed proof. You'll need things like that to help with your case. Also, contact your insurance company, your policy may provide legal counsel reimbursment. Either way, don't go into this representing yourself pro se. You'll have a fool for a client (old lawyers saying). Yes, lawyers usually take 1/2 to 1/3 of the winnings but you may be awarded enough to pay for the lawyer AND to get your car fixed/replaced.

Here's a big "also", if you DO go to court whatever you do DON"T tell them that this is NOT the usual route you take to go somewhere. The defense counsel will jump all over this and try to show that you were unfamilliar with the road leading to a delay in decision making for a menuever on the road.

And lastly, if you do go to your doctor and he/she does find something wrong as a result of the accident, the usual finding is 'medical costs X 3'. And try to only take depositions (these are different than statements) only when absolutely neccessary as they are very expensive!

I used to work for a lawyer and while I was employed at the law firm I got in a bad accident on my way to school when a guy in a Ford F-250 ran a stop sign and forced me to hit him. I swerved and forunatly did not T-Bone the truck. If I would have T-Boned him I would not be here in front of my computer typing to you!!! I ended up suing him because he cost me a car I loved, screwed up both of my knees and caused me to have a huge upper lip. The lawyer I worked for also got compensation for lost wages and pain and suffering. Really I got screwed up I didn't just want to sue for money I wanted to sue because it is my american right to get justice!~! anyway if your not feeling like crap today just go to sleep and see how you feel tommorow!! If you feel good today it is a sure bet you will be aching tommorow. THIS IS A FACT OF ACCIDENTS!

I hope you still have a TL whether or not it is totalled or not we still enjoy your company!

not necessarily - I would be unbelievebly pissed off if someone ever hit me. I would want to sue them for personal losses, and if they lost and I didn't gain anything from it, I would at least see the satisfaction of them losing something too. Although between us, the money would me nice!

Why? Why do you want to see them lose something? Do you think they saw you coming and thought, "hmm, i'd like to just ram this jerk, just for the fun of it"? IT IS CALLED AN ACCIDENT. Believe it or not, the person who hit you could be a very safe driver, got blinded or something else, and unfortunately hit you. Then you take him to court, where his insurance company won't cover damages, and you end up winning, forcing him, his wife, and his 4 kids to lose their home just to pay you. All so you could have the satisfaction that he was losing something. Sad, just sad.

Yeah i was in the same exact situation Mike was about 4 months ago - an @$$hole ran the stop sign and My LEX was gone it was totalled- at the time SUEing him was the only thing on my mind but then i realized that u can't do that and i also found through my girlfriend that he lost his job and is now unemployed with a family of four - so i couldn't do it - just as long as your ok and your alright thats the most important thing and you gotta realize $HIT happens

glad you're okay, and trust me... it's just a car...

if any of you remember what happened to me in November last year, I got rear ended at 50MPH by an F-150 driving 85MPH. Plus it was a hit and run. The total damage was 14 grand (including a hail damage which is about 2 grand). As a matter of fact, as we are speaking, I just got my TL back today and I miss it so much. I didn't really put in an effort into catching the guy cuz it's all covered by insurance and I am okay. Just a TL... I mean I did call the police and told'em the part of the license plate numbers but what else can you do... come on, sue'em? screw that BS son, you're fine and that's all it matters.

I believe I need to make my earlier point clear. You only need to sue this "Man, et al." if his insurance company and the insured refuse to pay to get you back to the condition you were in BEFORE the accident.

My girlfriend and I were rear ended lightly at a stop light a couple years ago. I was o.k. but she had neck trouble immediately while still sitting there. I did just as I listed in my previous post and the methodical way I went about it even impressed the other driver's insurance adjuster. She still has pain a little stiffness to this day but she did get $2,400 out of it for missed work and a lack of REM sleep for a week or so.

Again, I listed all of this and presented it with supporting documentation and the settlement never went further in the legal process than making a police report.

It did help that my attorney (whom I still contacted anyway) is my employer's husband and a local elected official. But none of that information was privied to the defendant.

The worst thing for you to do, and I'm saying you would/did, is to go calling this guy telling him you want $100,000 for pain, suffering and another car. For one the amount would be ludecrice (yes, I'm for award limits in cases like this) and he could then be sueing YOU for harrasment and intimidation because it implies you will take your own sort of vindication upon him personally (read- "Go beat the crap out of him").

So try to take it easy for now. Let the system in place try to do it's job.

I'm sorry to hear about the accident and I hope you'll be ok. I got rear-ended earlier this week and my car is screwed up and so is my neck. So I know how you feel.

But let's not jump on the bandwagon and sue. Your car will be fixed under the insurance policy and so your hospital bills will be paid for.

There's no reason to sue the guy. Yes, he's an idiot for running the stop sign and it sucks. But that's why they call it an accident. It happens. I was really mad at the girl who hit me, but **** happens. Tough luck for both of us. There's no need to scream "sue, sue, sue". The sad part is, most lawyers will be happy to represent you. This is why America has so many stupid lawsuits. Let's not make it any worse.

If you are injured, they will pay your bills and the judge will award you for punitive damages. Don't worry about it.

I did after my mishap and it was real funny because some of them were my clients from my job.

Also I had asperations to play professional golf. Before the accident I was planning on Q school for the following year. Now I can barely swing a club now! No, I won't SAVE IT. You are the first person who has made a somewhat ligitimate excuse to sue. Of course, that is only if the insurance companies won't cover the costs. I am sorry for your accident, as the person who hit you was obviously dumb, unlike the people who hit the other folks in this thread. There is a fine line between accident and stupidity. Drunk driving is stupid. Not seeing a stop sign is an accident. Can you honestly tell me that you think people should sue for every single accident?

What would you say about people who do see the stopsign and choose not to stop? I see that every day in the town I live in, that or someone deliberately running a red light. You know they're deliberately doing it because the slow down a little, look, then gun it. And sometimes it's necessary to sue, especially when you run out of insurance money and have to come out of pocket. In California the only way to get an at-fault 3rd party insurance to pay is to sue. It used to not be that way but our glorious politicians took 3rd party rights away. So if you're not at fault and are stuck with medical bills, lost wages, rental costs, etc then you have to sue to get it back.

As I said before, if the insurance doesn't cover the costs, that is when you would sue. As far as those people who deliberately run through a stop sign or red light, yes, they are stupid. But that doesn't mean every time someone runs a stop sign that they saw it. And it certainly doesn't mean that the person was deliberately trying to hit you. My point, which apperently is not a popular one, is that our society has a sue first attitude. There are cases where the system fails and you have to sue to cover your expenses, but the first reaction on 98% of the peoples minds in an incident, is sue.

ANYWAY.....sorry about your accident bro. Right now there are A LOT of complete baffoons on the roads in NJ; its almost like the NJMVS gives driver's licenses to anyone that's NOT clinically dead.

Sorry to hear about the accident and i hope everything works out. As for sueing its up to the person. I personally dont like the idea of sueing. I dont know if anyone of you read my thread on ACL.com but i was at circuit city when one of their employees pulled a truck in and hit the counter i was standing out sheering the top of my finger off. I wasnt planning on sueing despite the fact the finger couldnt be reattached and i have been thru 2 plastic surgeries and am in thearpy now (accident happened dec. 6) so i can have limited movement in the right two fingers. It screwed everything up for me (missed my finals and stuff) but i wasnt sueing until they stopped paying medical expenses So do what you think is right
