I got into an accident in early June with the CL. I posted pics a while back:

Anyway I just picked the car up yesterday and 20 minutes after I picked it up some kid in a new 330Ci decided to cross over a lane in traffic to get into a driveway and I end up hitting him and hitting the curb. It did enough damage where the right tire/rim is at an angle and I can't drive it. The left front bumper looks like I took a sledge hammer to it and I have a hard time opening the door. This kid had the balls to say "It looks like my dad has to buy me a new one. . " I just about kicked his ass right there, but the cop showed up. . .

I towed it back to the body shop and they just couldn't believe it either. Another 2 weeks in the shop. I think my car is possessed.

Man... sorry to hear about your misfortune. At least you could have put a few thousand miles on it before some ass decides to cause an accident.

That sucks man. Liek the other members said, you should trade the car in for a new one after it gets fixed. Devil's advocate or something like that since your car is red.

Thanks everyone. That's exactly what I'm going to do. I'm just going to wait until the 6 speed comes out. . . I think I'll go with blue this time. You'd think people wouldn't have a problem seeing me in a red car. Oh well . . .

Not yet. The cop says she needs to file the report and will determine fault at that time. It couldn't have been clearer to me who was at fault, but she didn't express her opinions. She tried to say at first I shouldn't have been in his blind spot, but I flat out told her that had nothing to do with it. It wasn't like I was tailing this guy in his blind spot. It just happend to be at that instant. I hope she sees it straight like the witnesses told her. . .

I can tell you right now, most likely you will not be at fault if he crossed over to your lane and tried to make a turn in front of you. It would be completely different if he had come into your lane first, then you hit him in the back as he turned. But according to your story, if he had cut in front of you while you were going straight and you ended up hitting him somewhere in the middle of his car, then it's his fault. I was in an accident very similar to this, so I know what the insurance guys will say. It's fairly straightforward to see from the damage location if he was in front of you or he cut you off.

Oh, and if you had witnesses (that are NOT friends) that can state he cut you off, hands down you win.
