wuzp with CL getting hit in Dec.... my car got hit too
wtf... my car got HIT AGAIN...
i was following this Rice nasty new black Celica ( with nasty bodykit and his stock 16" rims and altezza with red interior... anywayz) into my school's parking lot and he stopped at the LIL house where they sell Temp parking permit and i stopped too.. i guess he went too far and he passed the window and he started backing up.. i was like WTF STOP, so i HOnked but fucker was deaf or something , he still hit me. i was FUCK not again.. the lady came out from the LIL house and he came out from his car. his rear bumper was lil scratched... no big deal, and when i looked at mine.. the center of my bodykit is cracked.. i was like Ok.. how u wanna do this. since it wasnt that serious, we decided to just settle it ourself. i got his License plate # and driver liense # and his phone # and blah blah.... and i told him that i m gonna go get a estimate and call him up and he said ok.
after i came out from school i asked the lady if she could be my witness if anything happens and she said ok.. i got her info.
so i went to autoshop after school and they told me it would costs me around $250 to repaint my bumper and fix the crack.
so i called him and told him how much it would cost , and HE SAID " OH I THOUGHT YOU WERE GOING TO FIX URS AND I FIX MINE." I was like WHAT THE FuCK.. i told him he backed INTO ME.. and my car wasnt even moving. and he said " OH buT U WERE TOO CLOSE TO ME" i was WTF r u talking about... both of our cars were stopped to buy ticket and u dont know what the fuck u were doing and start backing up and i honked too.. what does that have to do with me following u too close and how far u want me to stay away from u in a parking lot when our cars were stopped"
He told me to call him up back on monday and talk about it CUZ HE S WITH HIS FUCKING GIRLFRIEND....
i said OK....
so i m just gonna call him on monday if he still fucking fuk around with me, i m gonan go fucking report him hit and run and shit.... arrest his ass..

well you won't be able to report it as a hit and run. Seeing that you have all his info and shit it'll be obvious that's not what happened. If he doesn't respond well on the monday phone call. I'd call your insurance company, give them the info on his car and they'll take care of the rest. It'll be your best solution. His insurance will pay for your car. Since you probally know the body shop that'll be doing your work have them up the quote. Make some money off the deal. And that fucker will get a point on his record.

never try to help somebody out when it comes to that. If there is no witness then call the cops, even if there barely is any damage. The cop doesnt has to write a ticket, he can just document it and say he was there, what happened and who was at fault

Dude, you left a scene of an accident without getting a police report. He can deny everything and say he does not even know who you are. You should have called the police or got the money on the spot.
The only thing you can do now is threaten to call his insurance and explain to him since its his fault, they will raise his premium. If he is as dumb as you describe him, he would just pay you the money. If he is somewhat bright, he would know that when you call the insurance company, they need a police report. If such does not exist, as is in this case, you are SOL. Good luck.

I made the same mistake last year... this guy hit my back bumper and put 2 nice scratches in it. He agreed to pay for the damage and gave me his info. When I went to the body shop (Acura) and they quoted $800 for refinising the bumper, I called him and he started denying everything and said the estimate is overpriced and he won't pay a dime. I was like "Buddy, it's a brand new car...I'm not gonna go fix it for $200 at some butcher shop"... He still didn't pay so I went to the police station.... the cop told me to go to his house and inform him in person that if he doesn't pay the cops will come to his house. I went to his house and the guy starts again, this time saying it is not his fault... I asked for his insurance info and he refused... so I said "Ok, you can expect the cops here within the hour, deal with them!!"
He got scared and followed me in his car to the police station. He starts saying to the cop "He backed into me and all that shit".... The cop then screamed at him "shut up and get in my office asshole"... they went into a room and I hear the cop screaming at him. 10 minutes later they walk out with the guy's insurance info and the guy appologizes. The cop then told me to call my insurance company and claim the living hell out of this guy... and so I did...
Moral of the story is if it is NOT your fault, insurance is the only way... your conversation at the scene of the accident doesn't mean squat! You can Hold onto the insurance info and let them know that if within 24 hours of the estimate they don't show up with the payment, you will CLAIM CLAIM CLAIM...

I had similar sh*t happening with my old car..... you trying to do somebody a favor, and people turn into as*hole....
If I ever get involved in the accident, even if its only a minor scratch, I am calling 911 from my cell phone imeadetly regadless..... You can't trust anybody, unless its your family or close friends...

all of you are confused, the police don't fill out a normal incident report, they're supposed to fill out a motor vehicle accident report specifically because thats what insurance companies require.
in NY u have 10 days from the date of the incident to report it, but of course doing it on site is way better. whenever its not ur fault, call insurance

Hurt or not does not matter. You can still file an accident report. You put his info, and the witnesses info in there. Then call your insurance company and give them the exact same info.

In this August post me and everybody else told you to best way to handle an accident, like when matis was rearended. The warnings were clear and you are not the first one to get duped like this. Perhaps you should have at least tried to follow some of the good advice in that thread especially after the accident happened. I don't mean to be harsh but what happened to you happens to thousands every year and no one including the police and the insurance company is going to spend a lot of extra time and money trying to resolve this. There are no crimes involved here, no one got hurt, just a lot of people with hurt feelings. Your witness unless she's a relative is never going to come to court with you. At this point, you might be SOL so you might be better off just trying to handle it thru the insurance company. And Rock, you must keep your vehicle a certain amount of distance from the vehicle in front of you. Too close and you are tailgating, moving or not. If you are tailgating, you will be responsible for the resulting rear-ending. Not says she was tailgating but if you come up too close to the vehicle in front of you and it rolls back into you....sounds like this guy was driving in reverse and hit you...alas we will never know for sure since there is a dispute.
My advice again from that thread:

And kept your own record clean, pay up the parking tickets, clear those warrants, so you can the police without getting [re]arrested.

As I said, Police report written by COP at the place of the accident is probably the best proof you can have in your hands.... otherwise, its your word against somebody's else.... and you getting into all kinds of grey areas.....
Excellent idea to have camera, also a good idea to have small tape recorder you can have in your pocket to record conversation with police officer and other person

But what do you do in case of hit and run, lets say someone hits you and takes off imeadetly, sometimes at night it might be hard to see license plates.... and *chasing* is stupid.... this has happened to my friend, and he got screwed... basicly he got rear ended by some Jeep, and the guy took off instantly, my friend was in shock that he could not really make out his license plate and besides the guy had one of those things that make your license plate hard to see....

What the police do is different in different locales. I know in LA, both my wife and I were told on separate occasions that LAPD does not come out or file if no one was injured or killed. Regardless, an attempt should still be made to formally file this with the police. I would also get insurance involved, but then again I have a low deductible and am not in high school and I don't have to worry about insurance premiums.

I've found that the legal route is usually the most painless route. If you get insurance involved they take care of all the issues for you (you pay them for that!).
Of course if you are at fault (and not in a no-fault state) and the damages are less then your deductible, it may make more monetary sense to just pay for the repairs and HOPE that the other person didn't do what was stated in the last few paragraphs.

What you should do is to file a police report first. Then, call this guy's insurance company and let them know that he hit you. Do not call your own insurance company because nothing good will come of that. By calling his insurance they will probably pay you and he will get screwed.

Read the fine print of your insurance policy and you'll find this to be true.
Contacting them does not equate getting them involved. If you are going 'by the book' you should file a report with both insurance companies, and then pursue action through the opposing insurance company.

Update:
I just called him earlier.. first he claimed that i was too close too him if his car WAS stick(which it was auto) he would backinto me too, i said bullshit.. if u know how to drive stick, u would know how to handle this kinda situation. and it s not like i dont know how to drive stick. Then he said he would pay half of the damage. i was like Forget it. i m reporting to the insurance. thenhe said Ok come to my work and pick it up tomorrow.
