So I just got hit as some of you may know, But I was wondering if you get hit and its not your fault what exactly should you do if the guy says hes going to pay for it,

take down his info, (thats what i did) and check with his liscience make sure it correct

but then what ??

And how do I make sure hes going to pay, and should you call the cops ?

is it dented? got to a body shop and ask if they have a pdr person and if it can be done and then maybe touched up. get an estimate and call the guy. if he refuses to pay ur SOL. no police report was made at the time.
just do the same to his car (not using ur car of course). with a metal bat or bar. ull think of something good.

Ive worked at a bar 8 years ( just graduated) , so I know some intersting people but I dont want to get them involved

But what do you do to make sure he pays ?????

i would have gotten the police involved. then if he didnt pay u call his insurance. and if he did pay, the insurance will call sometime later and u just say u guys figured it out.

what about the dents do you think they can fix them, and yhen do think they will repaint the entire side because Im going to get a couple of quotes tomorrow and I want to make sure it looks like it did before the accident

Someone rear ended me at a light. No cops came. What I did was just take his name, his phone number, insurance number, and license plate. I then called his insurance, told them what happened and they said okay bring the car to this place and well check it out.

They estimated it to a price what seemed to be too low ($700) so I just went to the Acura dealer bodyshop and got their estimate ($2000). They did the repairs and dealt with the insurance company for the supplement.

Basically I didnt involve my insurance at all so there was no chance of getting my premium raised which would suck because its already high because of my age.

I was at a stop sign I went forward and a guy coming the other way didnt stop and T-boned me I think I siad side swiped but It was more of a t-bone, Then we both stopped and he siad he was sorry and would pay for the damages. I took his info and # checked it with his liciense to make sure it was correct, then he took my info (Im not sure why but whatev) then I siad I would take it in tommorow and call him in the evening

Yea, wouldve helped for something thats not completely 100% obvious like mine was. He rear ended me, it was red light, his fault, 100%, end of story. Your situation, he might say something else and things might not go so smooth.

If you ask me its 100% his fault because he didnt stop at the stop sign and he hit me half way down my car

but if there are no witnises than I may have had some difficulty explaining it to the cops

He might come up with some story that puts some fault on you, so thats where it gets tricky.

If you want to go through his insurance instead of him paying for it, then call them and tell them what happened and they should deal with it. If your getting money from him, then it doesnt matter whos fault it is, right? He did say he would pay...

Whenever I get into a accident, first I check the damage, then call the police, then call my old man, then tell who ever hit me to stay in there car because i don't want to look at them at all ... ever.

You may still have time to file an accident report.

In the states, most places allow you to file a report within 24 hours. Id say do that just to protect yourself.

Its tough to tell in those pictures if its a sharp crease or dents, but if its a sharp crease its going to be difficult to repair. I dont know a whole lot about body work though.

Ive heard its a pain to color match/blend pearl paint unless the shop is good.

if someone hits you always call the cops. The guy can turn the story around now and say its ur fault and if you dont have a witness its your word vs his. He could easily say ur the one that ran the stop sign and he didnt have time to react etc. Could also end up saying that u both have to pay for ur own damage. For the damage it looks like you will need some bodywork and painting. Prob need to get the whole door and rear panel repainted and blended into the roof and front fender. Wont be cheap.

First of all, insurance in Ontario works much differently than most states in the US. We have "no fault" insurance which means everyone always goes through their own insurance. If the accident is deemed 100% the other guys fault, his insurance pays your deductable, so your cost is $0. However, insurance is based on risk, so your rates can still go up. You can just be an unlucky guy who's had 5 not-at-fault accidents, but you're still high risk in terms of insurance.

When you get in an accident, collect all the info you can, and get witnesses if possible. Then either call the cops or go to a collision reporting center. You can go here for the minor accidents. I would personally always call the cops, because they can see the situation and make a better judgement, and their written report is gold. Whatever they write down is "what happened".

For now you need to get a good quote and take it to the guy. If he is iffy about paying just threaten to go through insurance and his rates can go up. Hopefully that scares him into paying cash. Technically you have to report any accident to insurance no matter what. But, obviously in this case, doing it discreet may be best for both parties.

omg are you serious!!!!!!!! you always call the cops to get a report. the guy can now say you caused if he wants or he can just as easily say he wasnt the person who hit you. i hope that guy keeps his word for your sake otherwise your coming out of pocket.

I dont think there are any creases just dents but I went to see the cops after work yesterday and they siad try to work it out today and if the guy refuses to pay or any thing like that then come see them and they would do a report, he also took a look at my car and siad from what he sees we would say that its 100% the other guys fault so Im kinda happy about that any ways im off to the body shops to see what its goin to cost thanks

Also, one thing you may need to consider is what are you going to drive while your car is being repaired. If the guy would have went through his insurance,they should cover all your rental car fees. Will this guy be paying that as well?

with full coverage his name and plate would be more than enough.
No full coverage you have to file a report.
For the record, the only time I would call the cops if the ac got a beating.
Yours did,now you could probally have issues gettin the car fixed in a timely manner if at all.
It your word against his right ?

Even if you don't file an accident report, IMO it might be a good idea to try and take pictures of the accident. Maybe get a shot of how the cars are positioned, the whole intersection, showing that he bashed into you? Would that sort of thing help at all?

He did agree to pay im taking it in on monday and a car too drive is not a problem I have 5

He is reallly concered about me reporting it I dont think he has Insurance or a drivers lisience , I dont really care as long as it get fixed I am happy

I talked to the cops last night, they looked at teh car and said that if things dont work out by monday than I could come in and make a report and get his insurance company invovled. Its usually only 48hrs but he said that he would make a report saying that I came in and was going to try and work things out with the other party. so I covered my ass if he doesnt pay he also siad that if im the only one coming in that there is no argument it is 100% the other guys fault, But if we come in togther than he could argue that it was his fault but the cop said the way im hit is pretty clear it was not my fault

so it looks like everthing is going to work out, but ill have to wait and see if the guy does a good jod on the body work

Yeah He is going to pay the guy before he does the work on monday (he doesnt want to pay me directly) which I understand I didnt want to pay a guy I hit mainly because I taped his honda civic in my cherokee and it was 4gs to fix at honda , but I still understand ( in a perfect world thats how it would work but he doesnt trust me and i dont trust him)

The body guy is kinda a friend so hes going to call me when he pays and if he doesnt pay I can still do a report on tuesday

He Paid so as u can guess Im happy and not only that I needed my bumper painted and the guy is gave me a deal because im getting the other stuff done, he painting my bumper for $50 and that side of my car had little scracthes al over the rear quarter panel and a big dent where someone opened there door in to mine so it should be good as new in time for christmas (hopefully the body guy does a good jod). all in all to fix the dent and repaint that side which I wanted to do anyways, its going to be a pretty good christmas present.

i just got in a wreck....my fault. i gave him my info called insurance, then his dumb ass called the cops, they show up write me a ticket for something i didnt do. then all this other shit. an hour and a half passes and then we leave. my car i buffed clean and was done. same on his but wait. i have to pay a ticket. as long as u have his insurance and adress and tag stuff. then u good!
