I guess I just have to wait to hear back from my lawyer about my next move. This is fucking bizarre. Thanks for the replies, guys...I'm just fucking completely beside myself. You would think that, given that MY insurance company knows that I wasn't at fault and that a drunk hit me would be cause to give me a nice estimate so the fucker would get totalled. Unbelievable.

it's not your insurance, it's most likely the other persons. They are the ones that usually get the final quote on damage costs.

MA is a no-fault state. My insurance foots the bill, then goes after his insurance for the $$. This is why I'm confused as to why they were so CHEAP in their estimate when it's not even going to be them paying for it in the long run.

what also sucks is that the KBB price for your car is so high when you know that price would be nearly impossible to get

Damn Waltham and all the drunks around here. I'm guessing if they estimate that much from just the outside, then once they open up the car and get in there they will find a lot more. If you hit him that solid, then the damage on the outside should be somewhere near the damage on the inside. Good luck with everything, things like this just end up being very long and tedious.

Wow... that was almost as bad as my car on October 2002

They DID NOT total my car. The bill was $11,000. Took 7 weeks. Came out PERFECT. The dealer couldn't even tell. NO VIN records of the accident AT ALL. Strange. I went to one of the BEST body shops in NJ. Of course... no car is EVER the same after a major accident.

I have no solution for you, i'm sorry. but best of luck. u should go punch the stupid drunk in the back of the head. i'm glad you weren't hurt...

My best uneducated guess is that if the price is too high, they might have a problem collecting from the other insurance company who may complain or dispute the charges. I'm guessing your insurance wants to expedite the process and get paid. I'm assuming you're still not paying deductible since it was the degenerate's fault?

I'm assuming this is your process:

1. car goes to AoB's shop
2. they will estimate and open the magical hood of the temple of J32a2
3. more accurately estimate the car
4. decide whether or not to total
5. give you fat check for g35 or fix car 2 months later and get screwed by infiniti :p

Is this correct?

That's about correct, yes. I should have a better idea of what's going on with this by the end of the day.

I wouldn't worry too much about "diminished value" if the car is repaired and not totalled. In NJ, there is no such thing as diminshed value. If a car involved in an accident is repaired properly, it can't lower the value of the car as long as the car was repaired PROPERLY. But i would still try calling your insurance and tell them you feel very uncomfortable with the car and feel it will be unsafe to drive with a heavy front end impact and try to get them to work with you. ask them if they would reconsider totalling it.

Did you check more recently. On my friends car an accident report shows up on his carfax report. But it took a year for it to show up on it.

This just made me realize something I had forgotten. I was hit from behind in my CL when it was 4 days old. When I took it in for repair, I told the insurance company and the repair place to look at the suspension and anything else that could have been jarred by a rear imapact because the car was making noises it didn't make prior to the accident.
I later learned at a maintence service appt. that both mufflers had to be replaced because the baffles had become dislodged and were rattling against the metal inside. Thankfully they were replaced under warranty but I was really peaved that this was not checked when the car was repaired.
