Would it have anything to do with charging a fee for posting pictures larger than 1024x768?

okay i'll just tell u guys, hopefully he won't delte this one.

I was thinking of having like a montly raffle or just a raffle every now and then to support the fourm. He can raffle things like steel brake line, aftermarket brake pads, typeS carpet mats, CAI, wood trim kit. car cover, Zanio stuff basically anything from AUTOCARPARTS.com . who ever wants to join the raffle can send money via paypal like 5 dollar for each raffle ticket and then w/ the rest of the money we can buy stuff for the site/server/bandwidth.

Might have legal problems with a raffle unless he wanted to incorporate as a non-profit org.

non-profit status has nothing to do with corporate status. 501(c)(7) non-profit status (as a recreational club) prolly wouldn't be out of the question. it'd be a hassle, though.

Not unless you file all the proper paperwork with the IRS. I don't know what the rules regarding raffles are, but it seems that organizations like the Boy Scouts or churches can do it. But individuals (like Shawn S) can't raffle off things like their cars. So I'm guessing that maybe you have to be a non for profit corporation to make it legal.

there may be local or state law regarding the propriety of a for-profit entity operating a raffle or other gambling type operation (such as, well, gambling laws) but if it otherwise allowed by local authorities, the irs would generally not do anything to prevent it. they'd just take their cut off the top like any other taxable entity.

the irs would only get involved if you didn't pay income tax on the raffle proceeds and/or you claim tax exempt status under irc section 501.

as far as how they'd find out about such a venture, it'd only take one concerned citizen (netizen?) to point it out to their friendly field agent. the real question is whether they'd bother for such small potatoes.
