Sick of Transmission Problem

Ok I am pretty pissed off, I dropped off my '01 CL-S on the 7th of August and was told the transmission needed to be replaced. The dealer, Acura of Mission Viejo, has been helpful and got me into a brand new shiny red POS Grand Am rental. Unfortunately I was told the transmission wouldn't be in until next month.

So far so good, however, the thing that is pissing me off is that I called Acura Customer Care and told them I wanted to talk to a supervisor about it and was told I would receive a call within 3 days. Well 3 days are past and no call and no message. According to California lemon laws if a vehicle is out of service for 30 days cumulative the lemon laws apply. I am thinking if they don't respond to another call today within a couple of days I will see about going through my attorney for a lemon law buy back. Anyone have any thoughts on this? Depending on how this whole process go I may or may not get another CL-S/TL-S.

I have called Cory at Acura Customer Service many times and he has only returned one of my calls. What a way to treat Acura owners.

I would seek the help of attorney to get your money back under the CA Lemon Law. Having such a major item like a transmission go out so soon is justification alone that the car is a “lemon”! (I’m having my own transmission problems.) To make it worse, you’ll be in a Pontiac for 30+ days.

Let us know what happens!

I know exactly what you are going through!!! Last weekend my tranny went out while I was in Las Vegas. I spent the whole weekend fighting with Acura Customer Care about getting them to pay for a tow back to cali. and getting us a rental car.

My car is at Weir Canyon Acura in Anaheim Hills and they told me last weekend that the trannys were on back order and that they would probably have one for me next month

Why are we having to go through this with our brand new Acuras?????? Are they losing their touch. Something needs to be done about this. Let me know if you find something out about the lemon law!!

Transmission failure is NOT a Lemon Law case. YET!

If you really want to see Acura response time grind to a halt. Threaten them with the Lemon Law.

For all you CA people, check this site out: http://caag.state.ca.us/consumers/general/lemon.htm

Quote:
A special provision, often called the "Lemon Law," helps determine what is a reasonable number of repair attempts for problems that substantially impair the use, value, or safety of the vehicle. The "Lemon Law" applies to these problems if they arise during the first 18 months after the consumer received delivery of the vehicle or within the first 18,000 miles on the odometer, whichever occurs first. During the first 18 months or 18,000 miles, the "Lemon Law" presumes that a manufacturer has had a reasonable number of attempts to repair the vehicle if either (1) The same problem results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven and the problem has been subject to repair two or more times by the manufacturer or its agents, and the buyer or lessee has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (2) The same problem has been subject to repair four or more times by the manufacturer or its agents and the buyer has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (3) The vehicle is out of service because of the repair of any number of problems by the manufacturer or its agents for a cumulative total of more than 30 days since delivery of the vehicle.

If your car is sidelined more than 30 days, you might have a case...

Oh, btw, you don't need to go through a lawyer if you don't want to. All you need is to write ACURA Customer Service a "letter of intend" to file for a lemon refund/exchange.

I lemoned 2 POS MitsubiSHIT Monteros in a row without going through an attorney.

Fighting Acura is not easy, I got my engine block replaced after only 2000 miles. The car was stuck in the dealer shop for more than 4 weeks. I had 1999 CL loaner for the whole month. I settled for a 1,000 rebate check from Acura plus a 100,000 miles/6-years powertrain non-transferable warrantee.

The CLS is just doing fine...

Well just got off the phone with a supervisor, after calling and telling the operator that I was upset because I didn't receive a phone call yet, and the supervisor told me the transmission should be in by the first week of September. If they don't get the car finished by September 7, 2001 I am going to get started on the whole lemon law process, but if they do fix it I hope I don't have any more problems. Wish me luck

Be careful wioth the Lemon Law though. A friend of mine that is a Porsche mechanic bought a VW GOlf and has had several problems with it. He is using a lawyer and contatcing VW's corp office and he is still dealing with this car. He has had the car for about 6 months and hasn't even gotten a loaner car. He brings it in, they pretend to fix it, give it back, and he is back there within a week. You may have acase, but don't threaten lemon law unless you are truly thinking of doing it. Just tell them repeatedly you are unhappy w/ the service, and that you highly considering never buying a Honda or Acura product again. Bad word of mouth travels pretty fast and that may just wake them up... Just my 2 cents, change gladly given...

Something that worked for me and a couple of people I helped out.

Call the Acura Customer number and request an arbitration pamphlet. Tell them you can't find one in the car, and your understanding is that there should have been one included with the car's manual and other paperwork. Have it mailed to the house. Be polite! If they ask what for. Tell them that you are having some problems that are not being resolved, or even attended to in a timely manner, and that you may have to look into other options.

Believe me, this gets their attention and is not a "threat". I did this with my car, after the Zone Jackoff said "it is a characterisitc of the car. No further assistance will be given". Within a week of the arbitration pamphlet request, THEY CALLED ME!

I still had to go Lemon Law, but it got their attention. BTW, this was against Chrysler. They wrote the book on stone walling customer complaints.
