need opinion

need help fast


My 2004 tl that i was suppose to have is now not going to come in till nov. 15 the earliest. I just sold my car, so i have no vechile but my work truck. Now heres the choice they have a 2004 tl antchracite with ebony int. but no navi. . They would give me the car and a lip spoiler and some other stuff if I take this one. also my insurance said if i don't have insurance more than two weeks, I will go back under high risk and my insurance will be like 1,800 more. SO WHAT SHOULD I DO need help

I would demand that the dealer find the car you were promised. You were promised a car, weren't you?

yes but they said they would try to swap from another dealer, but theres not a good chance they will find one.

Did you pre-order the car though? Did they give you a reason for the car you ordered not being there? You should receive a loaner from the dealer until the car you ordered is in. That's really bad business if this is all in writing.

just buy a car under a thousand dollars for a few weeks so you can keep your insurance. When your car comes in keep the other car as a beater or sell it

Call your agent and explain what is going on....you shouldn't have to lose $$ because the dealer fucked up.

i called my insurance and they said only 5 days until u go back under high risk and they extened to two weeks for me. i think navi will make a big diference.

You got me here. WTF is the insurance gonna say? That they are going to charge you more because u did NOT have a car? As far as I know, you should be safe unless you have a car with NO insurance.

Talk to the insurance companies; what they are saying is just totally fucked up IMO.

Definitely keep the NAVI. It looks AWESOME in the new TL.

Just rent a Ford Taurus for a month and keep your insurance active.
How can they cancel you just because you’re in between cars?
Or take the earlier suggestion and buy a piece of SHIT car for 100-bucks.
Register it and let it sit in the driveway until the new car comes in.

Man insurance is so bogus! I'd just get a cheap beater and wait for the car you want. Are you getting the 6-speed?

is there any way the dealer can give you a loaner with a mini lease plan where u can add insurance to it until u get your car?

Its just an idea.

On the other hand i think the dealer just screwed you. U will need to take that TL in stock now or from another dealer. You should ask for a discount or something in order to offset their screw up.

You are going about this the wrong way. I imagine you signed something or received something relative to a delivery date after you put down your money. In almost every instance, you have now formed a contract (yes, I know, some states differ over this) for which you have recourse if the dealer has now breached the contract by not delivering the goods as promised. I'd review any paperwork you filled out, and short of caveats on delivery dates or something like that, I'd ask to speak to the owner of the dealership and demand a comparable car in three days...

Your insurance woes are because you technically have no insurable interest--meaning, no car. Most carriers do this these days to avoid the risks associated when people drop cars and coverage. You may be able to convert your current policy to a commercial type policy to cover your extended personal liability since you are now obviously using your commercial auto for personal reasons and then convert it back when your new car comes in. A good agent can explain all of your options, though in the end, you may not have any option on coverage without your own car. That being said, you put down money, you should have your car...

they will give me asscerioes on the one in stock with out the navi., the car looks fine without navi but looks better with it.

r10 has a point however, most contracts provide that in the event of breach by the SELLER - Dealer - the BUYER will receive the return of the deposit monies as sole remedy. There is not likley to be a clause for any equitable remedy such as specific performance which is used in the case of one of a kind items such as art and real estate. Therefore, I would look at the contract, but most likely are going to find that your sole recourse is the return of your deposit money.

If you are willing to take the hit to the wallet, you can ask the insurance company to reinstate the coverage on your sold car making note of the fact that the plates were returned to DMV and ownership of the car transferred. I did this for the period where I sold my Lincoln and picked up the CLS. The downside to this is that you will be paying for insurance that you are not even using. It all comes down to how bad you want the navi.

The dealer didn't fuck up...thats when he was told the car was coming...except he sold his car too early and thought it would be no problem...HOWEVER...in NY if you are not a current driver under an insurance plan for more than 5 days...you automatically go under assigned risk...no ifs, ands, or buts...thats the way it is in NY...maybe not other states. So...his options are buy an 04Tl w/o Navi now...so his insurance won't be affected...or wait til Nov 15th to get the Navi...and figure out what he can do w/ the insurance. We spoke to the sales manager today and he said he could probably get the Vin # on the Navi that he ordered...that way he can insure it before hand and when it comes in...it will allready be insured...no assigned risk w/ price increase...

thanks for all the replies ,I spoke with my insurance company and there is no problem. mY INSURANCE WILL NOT GO UP IF I WAIT FORE THE CAR I WANT. sO MY 2004 TL WILL BE IN WITH NAVI, SECOND WEEK OF NOV. NOT NEXT WEEK. bUT AT LEAST I GET THE CAR I ANT. thank you all
