In NJ, first offense is automatic loss of license for six months. Not really a deterint, as there are many drivers in NJ without licenses or insurance.

FYI: while we all know that alcohol is colorless, it is also odorless, which means, yes, no smell, anybody who says they smelled "alcohol" on your breath full of shit.

Sorry to hear your "little" trouble but you should be glad that you and your friends are still alive.
I was in similar situation once (when I was much younger without much fear for anyting) and I crashed my brand new Lexus into a lightpole doing something like 90 mph. I hit it so hard that the whole lightpole with its cement foundation traveled more than 40 ft. Although the car was totalled instantly (almost bent in half), I walked out without a scratch.
CHP came few minutes later and they told me it's nothing less than a miracle that I was uninjured. Anyway, they let me go without pressing DUI charge. I guess they felt sorry for me for losing my brand new Lexus.
Since then I don't do that anymore. Don't ever drink & drive unless you want the free handicap parking right for the rest of your life.

There was a consideration by the Supreme Court to throw out the reading of the Miranda rights. I'm not sure if it ever passed, but the claim was that it's not fair that a case gets thrown out cause someone dones't get their rights read to them becuase by now, everyone knows what their Miranda right are anyways. To throw out a case cause of that is just a plain stupid technicality.

I don't think that trying to work the system to your best advantage is a bad thing, since you seem to have gotten a bit of a wake up. In fact, those options to reduce penalties are the mark of a society that recognizes that everyone can make mistakes. As serious as what you did is being treated by the authorities, think of the magnitude of such circumstances if there had been an injury or death. When they give you a break, don't waste it a couple of months from now when some dope in a nice car challenges your manhood. ( cause that is what street racing is really all about anyway. isn't it after all? )
Some of the "Shutup Dad" comments here are very funny. It doesn't matter if the person who is trying to give you advise is perfect. The fact that someone who has made mistakes in the past is handing out the advice doesn't make it invalid. Sometimes it is profitable to learn from someone who has been there and can save you the aggravation of making the same classic mistakes. Nobody is trying to tell you what to do. Nobody thinks that they are better than you. In the end, each decides for himself. But not to listen is just plain ignorant.
But remember, most advice is bad if simply obeyed. Listen, really listen. Get past that feeling that all young men have to reject what you perceive as authority. What people say in here has no emotional baggage associated with it. Nobody is trying to tell you what to do. Think about what they say and use you mind to apply it to your situation.

They do give you your rights. It is posted on the form for your stuff that they pack away in the ziplock bag when they throw you in the tank.
They had no right to search your vehicle though.

As far as officers asking permission to search, they can...you can agree or refuse. As far as California, don't know enough on what's going on in California to comment.

Alot of people are just saying to take the DWI like a man. Well I am sorry but anyone would be stupid to do that.
Having a DWI can affect you in many ways.... especially if you have to drive a company car. I won't claim to be a lawyer... but I know atleast in Louisiana... if you file the proper paper work... it will come out to I think a $500 fine... and 100+ hours of community service, license suspended for 30 days (temp license only to go to school and work)... but it doesn't show up on your record. That is the important thing.
Do whatever you can have it off your record.. if not you will really regret it.
Having a DWI can affect you in many ways.... especially if you have to drive a company car. I won't claim to be a lawyer... but I know atleast in Louisiana... if you file the proper paper work... it will come out to I think a $500 fine... and 100+ hours of community service, license suspended for 30 days (temp license only to go to school and work)... but it doesn't show up on your record. That is the important thing.

Sorry to hear bout that. I've been pulled over with the same shit before and reading your story brough back memories... BAD memories.
Only difference was that I was 21 already at the time. I went to some of my lawyer friends to see what you could do about that Miranda thing... but someone posted a reply before I could and they basically mirrored each other in their advice... so there was no need to double post.
Another thing, I did my offense in DC where they have a 0 tolerance law. That means you can't have any alcohol in your system, .01 and ur screwed. DC has a program that if it's ur first offense and u did not blow a above a .09 you are offered a proram in which u just go to alcohol class and they drop the charges.
So... good luck..... VA is a wierd state.

I also think that VA has zero tolerance. My lil brother (18) has to go to court beacuse he blew a .01 on the breathalizer.

I think the legal limit if you are 21 or over in Virginia is .08. From what I have heard DC now has a zero tollerance even if you are over 21. That means if you go out to dinner in the city, have one drink, then get pulled over on the way home for anything you are fucked. I don't think the zero tollerance for over 21 is very fair.

nova, dont feel bad....that sh*t happened to me to, only that i hit a car instead. my reward for being drunk and driving was a 12 hour traffic school(all 12 houra in one day!!), 50 community service hours and $500 fine, since it was my first offense!! good luck and next time time your friend to pick you up!! LOL, that way you dont have to worry

For all that haven't tried it go to a korean restruant and get some really cheap too. around 10~20. for a bottle that can get around 10 shots. if you do get the reg one go get some lemonade mix and pour it in until it taste like lemonade.
Oh and don't drink and drive.

Yeah, VA's zero tolerance is only for those under 21. Not to jump on the bandwagon or anything, but you have to get a lawyer and try your best on this one NOVA. Yes it sucks that you made a mistake, and yes you should have known better, but that is all in the past and now you need to worry about your personal future. Many companies will not hire given a DUI on your record. Good luck - I've been there and I learned my lesson. If you see a black cl-s on the way to work, wave, it's probably me (i have the 20 mile commute too). Good luck, matt
