Gettin scammed on eBay, ironically by a member here..

I honestly never thought this would happen to me, but i think im actually getting ripped off on eBay... Seller is a member here, however i dont think hes been here in a while...

Basically paid for THIS item on 9/27/08 --- im not one to rush a seller to ship as i understand for some, selling on ebay is more of a hobby then a source of income... I am open with the fact that I ship items in a timely manner, however i dont teleport to the post office as soon as i recieve payment...

So with that in mind i gave the guy the benefit of the doubt in his slow shipping... after about a week and a half i started to send the seller emails through ebay asking if he got a chance to ship it.. No reply..

I send him an email to his direct email address a few days later and he replies that his grandfather is sick and is having open heart surgery, he is out of town but as soon as he gets back in town he will ship the item. He states he couldnt get ebay updates on his blackberry but that he checks his email as frequently as he can.

A few more days go by before i send another email... sympathizing with his situation, but also not completely ruling out the possibility of being swindled i send a very polite and sympathetic email back to him stating that i hope all turns out well with his grandfather, thank you for replying so quick i was starting to worry, etc.... i also ended the email with a solution, i told him i did still in fact want the item, however, if he was unsure of exactly when he would be back in town to ship, or if he knew he was going to be out of town much longer -- then i would not mind taking a refund, as i would not want him to worry about getting home just to send a car part at a time like this. (at this point it had been nearing 30 days since i paid)

I never got a reply from that email (9/19/08) and consequently opened a paypal dispute on 9/26/08. Escelated to a claim on 9/28/08 since at this point i didnt think his idea was to play ball.

He has until until 10/08/08 to reply to paypal.. as of today no repsonse to them or me.

My question is, this guy has already transferred the money out of his paypal account and into his bank account im sure, so there will be little paypal can do to refund me my money --- correct???

What are my options now?
File a dispute with my credit card company.. (has this worked for getting money back for any of you guys in this position?)
File a police report... however i dont even know if this guys address is correct... a brief google search on just his under ID shows hes in the military (he has a blog somewhere online that says this) so im sure he transfers to different bases/locations left and right.

what next?

Actually, if he did take the money out, and they rule in your favor, then he will have a negative balance and will eventually take the money from his personal account.

Had this happen to me on the sellers side however I did send the product. The guy just wanted to be an asshole so Paypal "froze" the funds and I was -$6000 for 25 days. If I hit 30 days, then they would have taken the money from my account and that would have been that. Luckily, I won the dispute as I delivered what was advertised and I got all the money back.

That's really irritating but don't sweat it. Paypal will refund you the money regardless of what his balance is if they decide in your favor (and they should).

Ebay's generally good with this stuff. Seller did a bait and switch on me--a burn of a rare cd and not the actual cd itself. I got a refund, he got banned from eBay for a year, and i got to keep the burn. lol.

Ralph- so it was YOU who I was pissed at all day at work for out-bidding me at the last second on this exhaust! I had been looking forever for a good deal on a set of Comptechs and was pissed that I missed out. Best of luck resolving the issue; you'll at least be getting your money back- I've been involved in a similar situation in the past and PayPal/Ebay are good at making sure that honest people dont get scammed.

9/28/2008 14:22 EDT - Buyer: Ive decided to escalate this to a claim. One reason among others is I havent had any reply from the seller Since 9/13/2008. I dont think I will be recieving my item, and if i wait the the 20 days for the seller to respond, which may not happen, and then wait 30 days for paypal to decide on the claim, I will have been without my money or my item for close to 3 months. This is unacceptable in any circumstance. Last email from seller dated 9/13/2008 he explained to me his grandfather was ill and he was out of state. With that I sympathize, so I replied that if he was going to be out of state much longer I would not mind taking a refund. However I have had no communication with seller since my last email, I dont have a refund or my item... My hands are empty. Please contact if you need email communications or any other information.

I understand there are extenuating circumstances, however it has been a month since I have paid, and I only have 45 days to file a paypal claim. Paypal refunded me only 200 bucks because i assume the seller has no funds whatsoever... I guess my next step is to contact my credit card company, then the police in Winter Park to file a report --- and then see if it wont do much good to get in touch with a department head or his commanding officer in the Army, maybe see if that might light a fire under his ass.

^ That sucks. Paypal only refunded me half of a $3,500 item. I hate them with a passion now. Never got my other $1,750 as of today (happened years ago).

I only use paypal for crap under $100. Never will I use them again for big items. Goodluck to you.

I have experienced an identical situation. The e-mails are not documented via e-bay. Never communicate a deal on ebay with personal e-mail addresses. Alway communicate via e-Bay messages:therefore, ebay can look it up because it would be saved in your account!

I am sorry but this is wrong.

I had a problem on ebay and thought by communicating through ebay worked as stated.

ebay asked for the message and email header. I responded I had deleted it and told them it was in my messages, they responded for privacy they are not allowed access to members accounts.

Save your messages is my advice.

well if it matters any i get kinda pissed at the ebay email system because you can only store messages for 31 days --- i opt to have all messages sent and received forwarded to my email address

I did, paypal gave me back 200$ (any of which i doubt was the sellers money) amex credited me the other $279, and i assume went after paypal...

I never heard back from the seller, im not sure if paypal got their money back from him...

Just a warning to people of a shady seller...

Dude what state does he live in? i had this happen to me once and the Po Po did nothing and i took shit in my own hands, lets just say i made my way to NY and got my Justice, my $, and some. Hell i made a day trip out of it, hahahahaha
just the look on the guys face was worth it all.

So if he's in my state I'll help you out, no questions asked

Well again, although i had to wait through the frustration and it took over 3 months i eventually got my money back... so did not pursue it any further... first had to file with paypal, then had to file with amex, and amex got me back my money...

Im not sure if paypal got their money back, i would hope they did as paypal is an ebay company and ebay is allowing this guy to sell on their site...

I just would like to warn other members to keep distance from his auctions and craigslist ads (hes got listings on orlando craigslist right now) ---

looks like the last guy got his stuff looking at his feedback, but thats exactly how my situation went -> guy before me ordered headers and received them, i ordered the axlebacks and never got them.

to this day i still cant understand why he stole the money from me and never shipped the exhaust, but i guess there are some low people in this world..
