Alphawerks = Automotoring = ebay seller? SCAM ???

I bought an Alphawerks header from a ebay seller called "jomacapa"
I recieved a defective items. AW and the ebay seller refused to replace it.
This is my seller's latest auction on ebay:

In this week, I've called AW seveval times; no one answers call at all.
Alphawerks' number Ph.# is 800-758-9105
The greeting says they are "Automotoring".
Today, I checked the address and phone number of my ebay seller on the box. I found that the sender's name is also "Automotoring". It is shipped from FL. And the phone number(786-331-2969) is actually connect the alphawerks 1-800 number.
I am so surpised. The MSRP in Alphawerks site is $750.
I bought it for $350. However, the headers are shipped from Alphawerks and it is defective.
I can't stop thinking about that Alphawerks is using eBay to sell their bad batches.
On their auction, it stated that "No return"
If you think I am wrong, please tell me what is going on?

Did they mention anything in the auction about the headers not being in working condition? If they didn't you might try contacting eBay and telling them that the product you received was not as it was advertised on the auction. Just an idea.

If you paid by credit card (even if it was a credit card through PayPal), call the credit card company (not PayPal) and put the charges into dispute. The description states "There is a warranty with alphawerks for one year." You bought them with this understanding and if AW says no warranty, then the product was advertised incorrectly. You did not get what you paid for.
I noticed he also said "as-is" in the description, but since he also listed a statement of "There is a warranty with alphawerks for one year," the implication is that the item is sold as-is but with a manufacturer's warranty for one year. The seller made a mistake by listing the warranty offer.
Hopefully you did use a credit card. Even if PayPal says thet can't do anything, your credit card company can if you contest the charges. Also, be sure to leave negative feedback for that seller.

ya doesnt that shit piss you off. i had just gone through the the same thing. paypal said sorry and so did AW and excelerate. i bought them in the group buy and they were defective
Also, it's understandable if the headers are cheap and low quality in which they do not last, but it's a whole different scenario when a defective product is purposely sold and its labeled fraud.

This set-up is the course of action you would probably want to pursue.
If I didn't know any better, I would assume this person works in law and has their J.D. . .
This is the advice you want to listen to.
Also, if you’re positive the eBay seller that sold you the product is the alphawork company then you may want to pursue contacting the FTC or even go into litigation.
Many companies do not get involved with eBay do to risk of lawsuits. This is because companies have greater risks.
If alphaworks is notorious for this type of fraud the court may grant punitive damages, which may cause the company into bankruptcy. Courts will not hesitate to make a poster boy out of an eBay fraud based company, which is causing corruption on e-commerce.

Your REP just asked me to tight it up instead of replace it ; you can check your mailbox and voicemail to see if you can find my record.

If the certified shop claims the headers have fitment issues it is now documented.
(2-515. Preserving Evidence of Goods in dispute)
Try contacting the company for warranty (2-601. buyers rights on improper delivery). If the company still avoids contact then this is when you want to push for litigation. (2-602. Manner and Effect of Rightful rejection) (2-603 Merchant Buyers Duties as to reightfully rejected goods) Homework time. This is the time to find all the people that have been ripped off by alphaworks. Take down everyone information who wants to join the class action suit. Class Action lawsuit would probably have better results. Except you would then have to split the punitive damages among the other plaintiffs.
One suit would probably go under breaking contract.
The promisor is breaking contract to the promisee.
The problem is that as a promisee(plantiff(you)) you expected to buy a product that fitted your car, yet you never received the product you were promised. This puts the promisor liable for breaking contract.
I don’t care if the product said sold as is. The product was defective, and it’s seller responsibility to notify the buyer of the impaired product.
If seller sales a defective product he is fair game to be sued. (2-609 Right to adequate assurance of performance) Look up this Uniform Commercial Code this is the core

Sorry excelerate I was just going by what i heard. Also I was thinking you kind of stiffed the customer. I thought you stiffed the customer because you never chimmed in and said your side of the story.
But, see this is good you responded, so the other members can see what you offered. If you never responded then this could of hurt your image.
Sometimes you get placed in B.S. because of problems between manufacture and customer, but thats the risk when being a seller.

I just sent my defective headers back to alpha werks and am waiting for a reply on what they are going to do for me...As for Josh at excelarate, he's been very helpful and professional. I don't think anyone can or should blame him for alpha werk's faulty product.
As for taking action, I would much rather get my money back then AW send me a new set that may have the same problem. I think we stand a better chance if we come together as a group...if some one knows where to go from here......

Moreover, it was proven only on a handful of cases that AW headers produced "more" power than OBX/Megans -- for the most part all "power" increases were nearly the same. Only difference is the welds on all three of those companies have had problems of cracking.
