AEM ECU not Legal in California...

I was reading about it on AEM's webpage and I saw this:

IMPORTANT: AEM Programmable Engine Management Systems are legal in California for off-road vehicles only and should NEVER be used on public highways.

Sucks for us I guess.

Oh and getting your cars inspected every 2 years in Jooisey isn't?

We don't have inspections, but smog tests.
If you just bought your car, you have 4 years till you test for smog

why can't someone just put a switch hooked up to the ECU that would place it in 'test' mode effectively turning the ride into a civic or something, then after the test switch back to full power..

hmmm..
