Actuator fixed, dealer was puzzled......
a) On how I knew there was a problem, and
b) How did I know where the problem was originating?
Props to the board from Gary Force Acura in Nashville.
The service guys thanked me because they had never heard of it before, but they said they will be sure to check any others coming in.
Thanks to those who discovered it! You really do lose alot of power in the upper rpm band when it's not working, so check your's now!

i had the same problem but doug from rick case knew all about and fixed it

You have to realize that not every Dealership has someone who checks or reads the net. The actuator problem is not widespread given the # of cars out there. It is quite possible that many, many dealers have not seen this problem, nor had any complaints about it. given that they don't read these boards, they really wouldn't know. Thats why its always good to give your advisor any info you may have- but don't try to diagnose the problem yourself- just say "hey- I read about this and think it may apply to this paroblem- can you check it out?" A good Service Advisor should be glad to if he can.

And fellas... let's not forget that probably 80% of the people buying this car wouldn't have a clue if their actuator wasn't working. I kinda doubt that many of the 60 yo ladies I've seen driving this car are taking it past 3500rpm on a regular basis.
As much as it sucks... we on this board are the exception, not the rule....

Look on the back of the engine for this.
Behind it is the actuator that controls the dual stage intake.
In park, rev the engine up past 3800 rpm. At 3800 it should visually rotate. If it doesn't, it ain't workin'.

I worked for two years as a consultant at Toyota Motor Sales implementing the system that they currently use for gathering technical information about problems in cars from their network of dealers. This system also disseminated information to the dealers (TSB's) once the same information they had initially reported was recognized as a problem.
Does Acura/Honda have something like this internally?
For what I see in this forum, many Acura dealers seem very ignorant of seemingly frequent problems. (rattles, steering wheel vibration during braking, dead actuator and others)
...or maybe they are just pretending to be ignorant.

I did it myself.
Stand on the driver's side with the door open, foot on the accelerator and rev the engine while looking at the actuator.
