Needs some opinions

I had taken my TSX to the local dealer to diagnose a few issues that I have before the bumper to bumper warranty expires. My first issue was a whine hum type of noise that appears at approx 40mph and over. It goes away as soon as you release the gas pedal or go into neutral.
I assumed it was the AT tranny and the mech agreed. He mentioned that he had a similar situation with a TL customer, they replaced the tranny but the noise was still evident or if I recall correctly it came back.
Now my question is that I'd rather perhaps live with a slight whine / hum noise than get my TSX butchered and have the tranny replaced, especially if the noise were to come back again. Also there was another noise, its very faint dull rattle. The mech on the test drive couldnt hear it, but again it goes away once in neutral. You also cant hear either noise if in gear with brake applied and reving the engine. So perhaps tranny related again. Unsure. I doubt its the prop shaft bearing, wouldnt this noise occur in neutral also?

I am not very familiar with AT boxes since Ive always owned stick shifts so maybe this might be normal I don't know. I just cant make up my mind whether to request replacement tranny or to live with it, I am almost 100% certain that replacing the tranny will bring on other issues that were not present before. Sorry for being so pessimistic but thats what a life long of dealing with mechanics has made me become.
Your thoughts appreciated.
