Even though carfax came out clean, it doesn't mean there weren't any accidents. The owner probably paid out the pocket to get it fixed. I would thoroughly check out the car.
I bought a certified used 04 with clean carfax and i noticed that the paint on the driver door had paint overspray on one area(not really noticeable).
Car #1 btw.

Gonna buck the trend --- Car #2.
Why? 11,000 miles is peanuts for these cars. And their starting price is lower then what you could get the other one down to after a bunch of negotiating.
Certified = good. Is is Acura Certified Preowned? If so there's usually extended warranty with those by default. Also, powertrain warranty should still be good for a while on both cars!
But as others have noted... nothing is assured until you see both in person and check them over completely for scratches, rips in leather, and everything else.

I agree w/ Curls on this one - I vote #2. Ext. warranty automatically comes w/ an Acura CPO vehicle. 11k miles is nothing on the TSX. Mechanics aside, I also prefer NBP to CGP.

Yes Car 1 is not Certified by Acura. Its at a nissan dealership. In all honesty I dont think the certified warranty is worth it. You pay an extra overhead for powertrain components. History says that nothing that isnt wear and tear is going to conk out on you anyway. (knock on wood).

Car 1 - has fewer miles on it equivalent to a years worth of average driving (or close to it) and the factory warranty. The only way Car 2 becomes a player is if they drop the price.

Could you get them to come down on Car #2? 40k miles for an Acura is nothing....my integra felt pretty much the same from 40k to 150k miles when I sold it. It would have gotten to 200k with no sweat.

I agree that the difference in miles is trivial in terms of reliability. Same story with my integra from 40k to 140k, except the shocks are wearing out for sure.
Maybe you can get a feel for how the two cars have been treated by their owner based on tiny clues. If someone lets the interior go to waste I bet they treat the clutch the same way.

Well i went to look at Car 1 today. It was real clean. Looked sharp.
Anyway, they came out with 18900 + Fees. I asked, what were the fee's. The salesman broke the fee's down as follows;
220 Etch
200 Doc
150 DMV
7 Tire Fee
6 Some other bullshit fee
Thats an extra $582 in fees.
So i told the dealer, i will pay 18K and all those fee's minus etch. We all know etch is the biggest bullshit in the industry.
He goes back.
He comes back with his manager Jason. I tell Jason, "Chris could have closed me without you". I dont think he liked that too much.
Then he says EVERYONE PAYS ETCH, etc. I wasnt going to argue with the guy. I liked the car. Then I go listen I like the car, I'll give you 18k and all the fee's plus the etch I'll buy right now and took out my check.
The manager then shows me all the fee's again. There is SUDDENLY now a $400 dealer prep fee.
I'm like what the fcuk is this? He said its dealer prep it goes on all cars.
Now before Jason came out I asked chris (salesman) what all the fees were. He showed me the little sticky on his desk that had all the fees. There was no dealer prep.
So I tell the manager, listen Chris just told me 5 min ago what the fees were, there was no mention of a dealer prep. Now all of a sudden there is a dealer prep? Manager says listen Im not going to let you walk for 400.
I said once again lose the prep and Im a buyer. He calls the desk and asks for an OTD number without prep, desk says no deal.
I tell them to fcuk off, and bounce.
Too many TSX's out there to give a douchebag like this my money. My max budget was 18k plus like 300 in fees. By the time i was walking out of thier we were just about 19k OTD. At that price i'm ALMOST at NEW TSX lease territory.
Thus my search continues.

That reminds me of my experiance buying my old Integra for 16k, but when I bought my first 2g integra for 7k and then later the TSX the sales people were friendly and straightforward. I wonder if post lease used car salesmen are more agressive than others by nature.
I did learn a lesson from the experiance though, which is private car lots are far far far more willing to fuck with you than a new car dealer becuase the new car dealers are accountable for holding up the corperate image in general, whereas used car lots may or may not care what impression they leave on car buyers.
Also the fact that new car invoices are fixed values probably makes their lives easier whereas a used car has a subjective worth and the math is anchored to how much the car was acquired for at an auction or for trade in.
I would buy used again if it got me a car I wanted but I'm far less willing to play games after having seen what is possible in terms of car salesman conduct.

This was no "rock lot" used car dealership. This was a pretty big Nissan Dealership in NJ. To be honest, Id rather buy a car from a rock lot dealership becuase A) They wont have the high fee's and B) They need to turn over their inventory faster, they dont have a monster automotive group with unlimited funds to just sit on cars.
Honestly I only plan on keeping the car 2-3 years MAX

Those are good points, but I don't think the need to turn over inventory faster plays a big part because the car dealer at a new car lot won't win any commission sitting on cars even if the organization itself has that luxury.
The most recent Acura salesman seemed particularly worried about us giving him bad marks on follow up surveys and would confirm that we were 100% satisfied with the car buying experiance. It was sort of sad in a way, but I wonder if maybe it was an auto sales equivelent of good cop/bad cop to build sympathy for the salesman himself and make us want to him favors.
