i was in an accident 2 months ago; a cab driver ran a blinking red light, hit my drivers' side door as i was going through a blinking yellow light. my insurance company (geico) called me and said that the cab driver's insurance doesn't think they're at fault, and are taking geico to arbitration.
does this mean that i'm screwed? essentially, it's my word and the police report against his word, so i think i might be fine. but is it typical for insurance companies to do this to try to avoid paying?

arbitration is where you cant find out the person at fault so then both of the insurances hire out lawyers and then go get a judge and settle "who's at fault"
make sure your story is simple and clean to the point, did you have any witnesses? i would if found to be his fault sue the cabby for taking to arbitration cause it takes time out of your day and not worth the hassle when he was eventually found at fault
im getting more money out of my guy that hit me cause he lied on his report he made to my insurance that he said i was at fault and the storey did not match up with the damage that was on my car
if you have side damage there is NO WAY it can be your fault cause unless you pulled a ebrake and slide into him sideways you could not be at fault

no witnesses...funny story about that. there *was* a passenger in the cab, but as soon as she heard that the cops were on their way, she bolted. gotta love west baltimore.
so, it's my word against his. but like you said, the car damage is pretty compelling evidence. btw, the cab had to be towed because of its front end damage (couldn't get the engine to run)...lets see how that one gets explained.
