Perhaps the tranny's gear range selector is off a tad.
Does the indicator lamp show the gear selected when shifting into it ?

Is there a way to adjust it or see if it's off? I love the car but that's super annoying especially in traffic.

Had a similar issue with an Accord ended up replacing the transmission.
The cause was, the owner never changed the ATF.
Have you tried changing the transmission fluid ?

No I haven't I just recently got the car but I checked the oil and it looks new it's not dirty or smells burnt. Would I be better off getting another 4speed tranny off a scrap car or rebuilt the one I have?

Thats strange, either it was changed before the sale or the cooler is clogged.
Yes preferably one with low mileage and make sure its from a 99 TL not Accord or 2000 and up TL to avoid headaches.

Forgot to ask what was the level ? was it between the dots, the engine must be warm and off to check the level.

Ok what would be good low mileage 100k and under? And yes I checked it just like that and it was right before the top dot.

As low as possible and check the fluid condition. 100k is fine as long as the fluid is in good condition.

Yes its by the drivers side wheel well on the transmission it has a black metal cover.

If that doesn't solve it then it may be a clogged transmission cooler, The way I test it is to loop the cooler hose on the transmission and try to see if the problem persists, If it doesn't then the cooler is restricted and needs cleaning or the whole radiator needs replacing.

After the test put everything back to the way it was.

Remove the gear position switch's cover plate and set the switch to the "N" position.
The switch will "click" when it's in the correct Neutral position setting on the switch's control shaft.
Keep the switch assembly from moving while tightening up the retaining bolts.

Recheck the dash indicator for gear selected and make sure that the motor won't start in any gear other than "P" or "N". Also check the rear back-up lights when "R" is selected.

It's best to have the tranny in Neutral when attempting to adjust or replace the switch.
