Surging acceleration '07

I just bought an Acura RL 2007 model and I noticed something that it wasn't doing during the test drive.

When the car gets good and warm it wants to almost surge as it accelerates. Warm as in driving it around for 45 min to an hour, not just getting to normal operating temp. To me it feels like it's losing fuel spark or air for just a split second.

There are no codes to point me in the right direction.

It only seems to do it in 1st and 2nd gear.

The mechanic says this is just traction control kicking in, but I'm not buying it. It does it with VSA turned off. When I mentioned that he just told me it never completely turns off, just lowers the tolerances.

Anyone have any ideas on where to start?

Here is a video of the tach 0-60 WOT. It's not nearly as noticeable in the video as having your butt in the driver seat but it's something.
