Dallas policewoman enters wrong apartment, kills resident

She thought he broke into her apartment. HOWTF do you not realize you entered the wrong apartment?

Police Chief Reneť Hall said a blood sample was drawn at her request to test the officer's drug and alcohol levels and "we are in the process of obtaining a warrant based on the circumstances."

Further details surrounding the death of Botham Shem Jean, a 26-year-old native of the Caribbean island of St. Lucia, were not immediately provided.

Hall did not say why the officer opened fire and declined to discuss what she may have been doing before she returned home after working a full shift Thursday.

His mother, Allie Jean, said in a phone interview that his family was stunned to learn of his death."He did no one any wrong," she said.



Dallas police in a statement said that preliminary information suggests the officer involved called 911, and told responding officers that "she entered the victim's apartment believing that it was her own."

WTF.

Not only do you get your apartment trespassed, the trespasser actually kills you. The fact that the shooter was a LEO likely has little to do with it, but you'd think someone who is in such a professionally trained field would be a bit more careful before discharging her weapon. Drunk? High?

Here's a local hawaii story recently of the OPPOSITE of this, homeowner kills a man trying to get into the wrong door/home by accident:

EWA BEACH, OAHU (HawaiiNewsNow) -Honolulu police charged Ewa Beach resident Gregory Farr with manslaughter on Tuesday in connection with a fatal shooting at his Ewa Beach home.

On April 15, police were called when several people in a residential neighborhood heard shots fired around 3:15 a.m. Police say the victim, 41-year-old John Hasselbrink, was attempting to open the front door of the suspect's home on Kaileolea Drive when Farr opened fire.

Hasselbrink, a chief petty officer who served in the Navy at Pearl Harbor for 22 years, died at the scene. Hasselbrink lived in the neighborhood, and was believed to have accidentally attempted to open the door to the wrong home.

On Tuesday, police charged Farr with manslaughter, and prosecutors also charged him for having an unregistered firearm.

Interestingly, those who choose to exercise their 2nd amendment rights when they mistakenly believe they are being home-invaded upon (when in fact it was police knocking on the wrong address) have been met with deadly force. A brief search shows two incidents where homeowners responded with guns drawn thinking they were the target of a home invasion when it was the police looking for a perp at the wrong address, both sides mis-understands the other and a gun fight ensues, usually with the homeowner dying.

When you respond to ANY perceived threat with firearms as your 1st, go to solution...it appears it's a lose-lose proposition for all sides.

It would be interesting to see if the apartment resident in this case drew a gun/weapon thinking he need to defend himself from a home invader and the LEO responded in kind. I can see that happening.

It would be weird and inconsistent to leave the door unlocked and at the same time have a gun for protection against a home invader.

This one has me scratching my head pretty hard...

The apartment building used little key fobs to unlock an electronic door lock, so no physical lock to not fit a key into a lock. Hers didn't work on the door despite a few attempts, and when the actual resident noticed someone trying to get in, he opened the door and was subsequently shot.

The only reason for her confusion that I can remotely come up with is that either she or someone else on the building elevator pressed a floor other than hers and she got off at the wrong floor by accident. If every floor basically looks the same, she might have walked to the place on that floor where her apartment would be and tried to enter, not realizing she was on the wrong floor. Certainly no excuse, and charges are probably due here.

Does Texas have "Stand your Foyer" laws? How about "Stand your Hallway outside your apartment" laws?

I can't imagine her walking on this one, nor do I think she should.

Meh, if it happened like Stogie said (key card didn't work and the dude opened the door) and he threw the door open and had a weapon of some type in his hand or aggressively advanced on her, it might be justifiable... Too many unknowns at this point. Will have to let it all play out....

I predict a conviction.

She went from 0 to 10 in a hurry... Lot's of other options she could have entertained. Plus, her training may be contrary to what she actually did.

The Texas Rangers released what was effectively her account of the ordeal. She worked fifteen hours, parked on the wrong floor by accident, went to insert her key into the door, the door was ajar and opened slightly as she put her key in, she enters the room which is dark, sees a shadowy figure, presumes she’s being robbed and fires two rounds.

However, eye witnesses heard loud banging on the door with a woman’s voice saying, “let me in.” Family and friends say the guy was meticulous and would never leave the door unlocked or ajar. He also supposedly put a bright red door mat in front of his door as a way to uniquely identify his place.


The biggest question to me is why the PD hasn’t released the toxicology report.

Guyger then went into Jean's apartment and called 911. She turned on the lights and when dispatchers asked where she was, Guyger returned to the front door and discovered she was at the wrong apartment, the document says.
Her own statement says THAT is how she discovered she was at the wrong apartment. If you thought you were in your apartment why would you feel the need to double check the door for your own apartment number? I wonder if they misquoted her statement, though.

According to the DPD Chief (a black female), Guyer herself requested the tox screen, so I wouldn't try to read anything into how/when it's released....
