TAMPA, Fla. (FOX 13) - Anyone who has received a robocall from the Resort Marketing Group about getting a free cruise could be eligible to receive up to $900 as part of a class-action settlement.

According to the class-action lawsuit, the group made "pre-recorded telemarketing calls to landlines and cell phones offering free cruises with Carnival, Royal Caribbean, and Norwegian as promotions," which violated the Telephone Consumer Protection Act.

Many of those who received the call between July 2009 and March 2014 could be eligible for up to $300 per call, with a maximum of $900.

If the claim is accepted, consumers will be compensated for each call received, at a maximum of three calls.
I qualified, so did my sister and a bunch of friends even a few friends in Ohio and Minnesota.

If there are a lot of people filing claims (more than expected), people could get much less than $300 per

If your claim is accepted, you will be compensated, based on Resort Marketing Group, Inc’s Call Records, for each call received to the phone number at a maximum of three calls. The value of each call is capped at $300. The most you can receive per telephone number is $900. If the number of claims filed does not allow for compensation at the maximum amount, then you will receive a pro rata share of the Settlement Fund after the payment of Attorneys’s Fees and Expenses, the Incentive Award, and Settlement Administration Expenses.

Funny enough my boss and I used to get these calls all the time. They kept asking us for our credit card numbers but we jokingly kept asking if the cruise is free why do you need our credit cards? Using the Adam Sandler grandma voice we'd put them on hold and pretend to call our families and tell them good news about the free trip. It was fun to see how long they would stay on the line. Ahhh good times

I'm doing this for sure. Not gonna miss out on money again.

a while back there was a class action lawsuit for some hotel. I got lazy and didn't do it. Found out later my friend did it. He ended up with like $700

I hate class action suits. Regardless, I entered this one just for some more info.

From the FAQ's, the max that can be awarded to claimants, after lawyers are paid, is $8,333,375. At $300/call, that allows for almost 28k claimants to get reimbursed for one call. From the two claims I submitted and claim numbers I got in response, the number of claimants is growing at about 20/minute or 1200/hr. That will exhaust the pool to fully pay 28k claimants in under a day. Then, payments get cut.

There are still a couple months left for claim registration. I think $3 in the end is wildly optimistic. This is one of the reasons I hate class action lawsuits.

The Court has authorized this supplemental e-mail Notice to inform consumers who have filed claims that, to date, over two million claims have been filed seeking to recover from a Settlement Fund expected to total $12.5 million.

Due to the large number of claims, the individual recovery per consumer will be a pro rata share of the Settlement Fund. The exact per consumer recovery is still unknown, but it is expected to amount to several dollars per Class Member.

So now, the claims administrator thinks that a significant number of claims are fraudulent. Now in order to validate your claim, you have to submit proof that you owned the phone number you submitted the claim for. And, you also have to provide the claim number with the documentation.

Considering how few people have probably recorded their claim number and how few probably have phone bills from that timeframe for documentation, as well as how many people will want to expend the effort, the number of valid claims may drop enough that we could see several more dollars!
