Trying to File Taxes
Ok so my wife and I got married in 2009. We do not own a home but I live and work in VA but she lives and works in KY. I was trying to file my taxes on Turbotax as Married filing jointly. Apparently, VA won't allow us to file our taxes as married filing jointly since she works and lives in KY. I guess my first question is, Can I put my wife as a resident of VA and just making income in KY?
If not, what are my options? I do not want to file separately on my federal return cause it gives me a much lower refund. TurboTax suggested that I file a federal return as married filing jointly but then file our state returns as married filing separately or something of that nature. I am not really sure how to do that in TurboTax. I am really confused. Anyways, hope someone out there knows the answer. Thanks

I think you should consult a tax specialist.
For VA, might have to prove that she lives with you more than half the year. If not, then she is a resident of KY, and does not need to file taxes with VA. Hence you should file single in VA (at a higher tax rate). You cannot file marrier filing separately in VA (unless you can prove she lived with you more than half the year).
Same thing in KY. She would have to file single in KY if you did not live with her in KY more than half the year.

Why would I have to file single in VA if I am not single? That doesn't make sense to me but I think I see what you are saying. If I file married filing separately in VA then they are expecting my wife to file in VA as married filing separately as well.
Anyways I think I figured out the solution. My wife and I file our federal return ONLY as Married Filing jointly. Then go back and file our respective state taxes as Married filing separately. I believe thats the way that TurboTax wanted me to do it. That way she would be filing her KY taxes and i would be filing my VA taxes.
